Why do illegal immigrants have the right to an attorney? [vanity]

Just watched an episode of The First 48 (great show, btw), and the two suspects were Mexican nationals, aka illegal immigrants. The show did acknowledge both men are/were in the country illegally.

The police got a surviving victim to identify the suspects in a photo line up. Then the police found them hiding out in rural west Texas and brought them in.

Right off the bat they both asked for attorneys. Why do they have that right? And of course it's absurd that they get taxpayer-funded public defenders, but that's not really the issue. If they're not citizens, why do they get the rights of American citizens?

I don’t like them getting attorneys but I do think they should have some kind of representation to make sure that they really are illegal. Mexico should be chaged for their representation.

Beyond that all they should get is humane treatment and speedy deportation.

For immigration proceedings, Holder changed the policy from no counsel, to yes counsel in June of 2009...

Because rights come from God, not government.

Government can grant priviliges, but not rights.

Every criminal suspect has the right to an attorney. The US Constitution applies to everyone in the US, not just US citizens. Of course, you are speaking of illegals being charged with a felony, not just being deported.

They are not citizens, the do not have the right to free speech, the do not have a right to bear arms, we can quarter troops in their homes, we do not need a warrant to search their homes and they do not have a right to remain silent.

Because the Sixth Amendment, which guarantees the assistance of counsel governs the rights of the accused. Any accused. Regardless of the crime. Regardless of citizenship.

The nearest Mexican consolote, or whatever it is should send the lawyers...All illegals should get attorneys from their country reps. Paid by same. MO

The Mexican Consulate is supposed to be notified to send a Mexican Lawyer to act as Co-Council for the defense next to the U.S. Defense for each defendant.

I firmly believe that foreign nationals should not be afforded the same rights in the US as our citizens are.If that means that these aliens refrain from coming here I guess we'll just have to deal with that.

Certain parts of the U.S. Constitution limit certain rights to "Citizens." (For example, Article I, section 2, specifying who can run for Congress). Other parts use broader language. The Sixth Amendment says that "[i]n all criminal prosecutions, the accused shall enjoy the right ... to have the assistance of counsel for his defence" (emphasis added).

This is a criminal prosecution; the aliens are accused; they have the right to counsel.

That's probably not a bad idea.

As other posters have pointed out, the day may come when YOU are accused of being an illegal immigrant. Being such is a serious crime and the burden of proof is on the government.

Once the government has met their burden, then judges should punish the criminals such that the punishment acts as a deterrent. I know I wouldn't get a free ride if I broke any of the thousands of gun laws in the U.S.

If not for the penalties ranging up to ten years in prison I would keep and bear arms as I see fit. That simply isn't practical with the legal infringements in place today.

The same should be true of the completely justified laws which protect our borders. Deterrence works. I am very angry with the government for this double standard.

Do they have freedom of religion? Or could President Romney by executive order decree that all illegal aliens be forced to convert to Mormonism?

And it looks like it was the Bush Administration than granted legal council to illegal aliens.

I assume you are being facetious, but you should consider the implications of your view that the First Amendment doesn’t apply to aliens.

Snip: If you think $250,000 for one year is a lot for one informant, ABC15 has learned he’s not even the highest paid.  Another Chandler narcotics informant made around $500,000 over a 14-month period last year.
