Justices poised to strike down entire healthcare law

The court’s conservatives sounded as though they had determined for themselves that the 2,700-page measure must be declared unconstitutional.

"One way or another, Congress will have to revisit it in toto," said Justice Antonin Scalia.

Agreeing, Justice Anthony Kennedy said it would be an "extreme proposition" to allow the various insurance regulations to stand after the mandate was struck down.

Meanwhile, the court's liberal justices argued for restraint. Justice Ruth Bader Ginsburg said the court should do a "salvage job," not undertake a “wrecking operation." But she looked to be out-voted.

Chief Justice John G. Roberts Jr. and Justice Samuel A. Alito Jr. said they shared the view of Scalia and Kennedy that the law should stand or fall in total. Along with Justice Clarence Thomas, they would have a majority to strike down the entire statute as unconstitutional.

Our founding fathers dreams and plans lay in wait for final word if the Republic, our Liberty and Freedom shall be dissolved or not. Shall we be subject to enslavement by what was once our government or not?

When the Judicial branch performs such a "line-item veto" on ANY law is nothing short of legislating from the bench (to which I'd expect this shameless little yotch to say, "So, what's the matter with that?").

On a related note, if by some miracle the Obamanation loses in November, I wonder how many aging libs on the SCOTUS will immediately resign, giving him and his 'RAT-controlled Senate the opportunity to pack the Court before he leaves office.

This is very premature.

There are only 4 conservative justices. We’re relying on Kennedy to determine the validity of the US Constitution here.

I sure hope so! Of course, Obama will be back immediately with something equally bad, or perhaps just impose it extra-legally. Actually, it won’t be immediate, but right after his reelection (while he’s also busy selling us down the river to the Russians).

As it is, the Constitution's protections for individual liberty are hanging by a thread.

Perhaps the Justices fear the wrath of future generations who, using current and future technologies, will read their nation's history, and know that this Court's decision on this blatant "power grab" disguised in various semantic terms as related to "health care," either preserved their individual liberty, or contributed to the destruction of their freedom.

"The People" in the 1930's through the rest of the 20th Century did not have ready access to every word of the reasoned debate of the principles essential to liberty. Now, they do, and that must be a powerful motivator for this and future Courts who decide on matters of freedom versus government tyranny over individuals.

No longer will their actions be measured by current opinion, but must stand the scrutiny of being compared to the ideas of the Framers of America's Constitution.

Great. Get rid of the whole damnable thing. The same with the entire Obama administration. I want them fired “in toto” come next November, and frankly some of them ought to be investigated.

I will dance in the streets the day this administration is out on its big ears.

This concerns me somewhat. I’m quite unsure as to how Kennedy is going to rule on the mandate, and am concerned he may go the wrong way if he doesn’t want to scrap the whole thing.

BTW - I’ve always blamed Bob Stanley.

The administration indicated it was prepared to accept a ruling that some of the insurance reforms should fall if the mandate were struck down... the court should go no further.

Looks like we may be heading for a "how many divisions does the Supreme Court command?" moment.

About 2.5 million young people under age 26 are on their parents' insurance now because of the new law. If it were struck down entirely, ...

One dirty secret is that many of these children are NOT carried on their parent's insurance because of the additional expense.

In order for parents to carry every child up to 26 years old, regardless of employment status, marriage status or where they live, someone has to pay the piper and this cost is added to the parent's insurance coverage as a supplement.
