Because the current byzantine system would require the sheriff’s office to pay for his treatment if he is taken early into custody, frequently the sheriff just waits until the person leaves the hospital unless he seriously expects the person will vamoose.

an appropriate punishment would be for him to have to move to said town and rebuild, by hand, and at his own cost, the entire building. Grab a hammer and start pounding and keep on pounding on the buildings in town until the debt is paid in full - should take him 8 or 9 years or so unless he's got a rich daddy.
