Most observers of trials think this way because they think the jury will come to some kind of compromise—we can’t convict her of the worst charge because that wasn’t quite proved so let’s convict her of something less so she doesn’t get away scott free. The problem is that each and every charge has to be proven beyond a reasonable doubt, independently. That’s a very hard thing to prove in any trial with any jury, let alone with a case where all the evidence is circumstantial. But that’s how our Constitution was written.
