So they've concluded that he was pointing it at them after the fact. And there's no possibility whatsoever that the rounds striking the rifle (which I guess is what they are talking about when they say they "examined" the rifle) hit it after he was struck and his body reacted...right?

Guerena was at the end of a hallway holding a rifle when officers began shooting at him, SWAT officers said in narrative reports of the raid.
Guerena did not shoot, and his AR-15 rifle had the safety on and a round in the chamber when he was killed, sheriff's officials said.

If I was headed down a hallway I would have my weapon facing forward as well though I would have already flipped the safety.
Facts are inconvenient things sometimes, aren't they.

Deputies first said Jose Guerena fired at officers...
They used that as justification to open fire.

"The officers were mistaken in believing that Mr. Guerena fired at them," Berkman wrote. "However, when Mr. Guerena raised the AR-15 semiautomatic assault rifle in their direction, they needed to take immediate action to stop the deadly threat against them."
How could he raise his weapon to threaten them when he didn't even get the chance to do so? They "heard a shot", so they say, and immediately opened fire! He may have raised his rifle after they started shooting, but I don't see him raising it beforehand.

This story has more holes in it than Guerena's body.

Kind of an important little detail. The SWAT team had no cause to see Jose as a criminal of any kind much less dangerous.
