If you remember, I questioned whether Obama was crossing the line into sedition with his statement that he intended to ignore a declaratory judgment.

Well, they apparently (after stalling) asked the Judge for a stay, and got something a bit different than they asked for in reply.

Judge Vinson began with:

I’m not so sure they can ignore this one. They played a very silly game seeking ‘clarification.’ They lost, big time.

In the LA case where they are ignoring Judge Feldman’s ruling, and trying to override with Executive Order, they have appealed, and appealed timely so far as I know.

The Vinson Order grants a stay only, and for 7 days only, pending their filing an expedited appeal. If they do not, his stay is dissolved, and his Order becomes the law that has to be followed, pending its being overturned by a higher court.

They were already out of time to file their appeal. I’m not so sure they wouldn’t be barred from appealing if they fail to do so within the next 7 days. Any other litigant would be out of luck if they missed a deadline. So, there comes a point where the games end, and even these guys at DOJ have to perform and defend their case.

I can’t imagine what they are so worried about. After all, haven’t we heard a lot of bragging from the White House that they are 3:2 on judges ruling in their favor?

They can and will ignore it. There is no controlling legal authority. Why appeal when you don’t have to......

The press will not cover the ‘enormity’ of this event. [Communist coup] The Obama admin with the help of the DOJ KNOW with certainty they will NEVER be impeached much less held to account for their actions.

They will continue implementing Obamacare even if Judge Vinson ignores all the threats to his family and friends and finds the admin in criminal contempt. If the Judge wants people in jail, who is going to carry out the order?

As I understand the Opinion, which I’ve only glanced over, the 26 states in the suit are freed NOT to move forward to implement Obama care in their states if the expedited appeal is not filed. So it’s not “just” Judge Vinson, it’s 27 Attorneys General, 27 states that would immediately cease any activity to promulgate the law. Do you think DOJ would be willing to defy that many states and the federal judiciary? I wouldn’t count on it.

The way I see it, Obama and the DEMs have 3 big problems related to this:

1. If Obamacare goes to SCOTUS and is ruled unconstitutional, they are gonna look like CHUMPS for frittering away time spent on this at the expense of the economy and unemployment. This will not bode well at the polls in 2012.

2. If Obamacare is rule constitutional by SCOTUS - it will galvanize the voters [at the MINIMUM 45-52%] who are already against them on this in 2012. And, if the economy and unemployment are still in the tank at that point, 10-12% of the others are gonna vote against them.

3. If Obamacare is still being litigated in 2012 at the time of the election, same outcome as #2.

Among the many reasons I love FR. Reading the MM stories about this ruling, it seemed like it was a victory for Obama and the statists. I was irked. Now I feel better!

I was mad too that’s exactly what I thought he had a victory. I purposely go read alternative sources that give a more realistic breakdown these days because I know the mainstream news no longer provides that so I get excited when I find something that does. I like the fact that others do the same on site too.
