The M.E. will probably say whatever he's told to say. But even if he doesn't, Supervising Deputy District Attorney Vic Stull already said "The law only requires that we prove an approximate cause of death." So if somebody killed her because of the injuries caused in the accident, that's close enough.

Rightly so, but I don't think that's what we choose a health proxy for. The proxy simply stands in for us if we are incapable of making medical decisions. That means overseeing our course of treatment, not (necessarily) ending it. A so-called living will cannot anticipate the future or the state of medical science, but a proxy will be there to guide things in a human way. Makes FAR more sense to me.

Is he saying she was approximately dead? I think he himself is approximately alive and approximately from planet Earth, but not quite.

The slow starvation and dehydration death of Terri Shiavo was the most reprehensible act committed by the US judicial system in years.

(Especially considering that Terri's parents were 1,000 percent willing to take over her care, and the fact that the so-called husband had abandoned her which in effect should have negated his control over her affairs.)

Many of those leaders (like Sen. Santorum) who stood up in support of this woman ultimately suffered at the ballot box due to the selfish people who said one of two things to themselves.

It was either, "Gee, how dare the government get involved in the personal affairs of these private citizens". OR "How dare the court force me to keep my spouse alive, especially if I didn't love her anymore and especially if she was a physical and financial burden."

Ironically, the government already plays a HUGE role in the lives of ALL couples every day through divorce laws, estate taxes, child custody, and everything else one can think of.

Surprise, surprise,

We posted earlier on poor Rebecca and the underwhelming efforts of DSS to protect her. They were too understaffed to help her, but have enough resources and tenacity to cling to ownership of Haleigh Poutre as an object of great value once they were thwarting in killing her.

One day before little Rebecca Jeanne Riley died, a DSS supervisor approved a surprise visit to the girl’s home, but it was too late.

 That was one of several ill-fated attempts the agency’s overburdened workers made to protect the girl, Department of Social Services Commissioner Harry Spence revealed yesterday as he battled back against tough criticism.

     Spence painted a picture of a woefully understaffed agency with fewer than two nurses, no staff doctor and oversight of 40,000 children, many requiring foster homes and medical treatment.
    Still, he said, DSS social workers did everything they could to protect Rebecca, 4, who died Dec. 13. On Dec. 12, a supervisor approved a surprise visit to her Hull home after repeated attempts to reach her mom, Carolyn Riley, to set up a monthly check-up, he said.

And DSS spokeswoman Denise Monteiro said DSS knew Rebecca’s dad, Michael J. Riley, who is charged with sexually assaulting a 13-year-old girl, had been granted unsupervised visits with his kids in the summer of 2006. That decision was made by a judge, she said, and DSS was not able to reverse it.
    Spence said “this child did not fall through the cracks nor did Haleigh Poutre fall through the cracks.” Poutre is a Westfield girl whose family’s DSS history bears chilling similarities to that of Rebecca, whose parents were charged with her murder Tuesday. The Rileys are accused of drugging the girl to death with Clonidine pills, which she was given for attention deficit hyperactivity disorder.

Rebecca's parents have been charged with first-degree murder for allegedly giving her an intentional overdose of Clonidine, a blood pressure medicine for adults that is also used for children diagnosed as hyperactive. Children are diagnosed with mental disorders at earlier ages and routinely prescribed drugs for treatment. After a therapist expressed concern to DSS that Rebecca and her two older siblings were overmedicated, the agency was assured by doctors that they were medicated properly.

After doctors misled Department of Social Services caseworkers in the case of a Westfield girl who was almost beaten to death by her foster parents, the Legislature gave the department $1 million for a panel of independent medical advisers.

But the agency hasn’t been able to find physicians willing to serve despite six months of trying, Commissioner Harry Spence said yesterday.

Doctors have declined to join because the department’s cases are invariably controversial, Spence said. ‘‘There are also issues of liability, hospital privileges, and (getting access to) medical records,’’ he said.

A paraplegic man wearing a soiled hospital gown and a broken colostomy bag was found crawling in a gutter in skid row in Los Angeles on Thursday after allegedly being dumped in the street by a Hollywood Presbyterian Medical Center van, police said.

The incident, witnessed by more than two dozen people, was described by police as a particularly outrageous case of "homeless dumping" that has plagued the downtown area.

The ol' #1 bureaucratic defense after getting everything screwed up: we need more money. But that does not begin to explain why this agency failed Haleigh so miserably, so often; why it tried to kill her; and why it won't let the child's mother and grandmother visit.

God only knows what they did to Rebecca. And while we're at it, why did that judge give visitation rights to a man known to have committed sex offenses with a 13-year-old girl?
