I would imagine that Libby's lawyers will have to be told of any doings in a new GJ. And Libby's lawyers can use that information as they see fit.

Hehehe- yeah, in all likelihood the road leads to Powell. And lets see the Dems scream for his head.

The great irony is that Libby will probably get sprung because of Pincus (of all people) and Fitz has to subpoena him because Woodward has made the whole thing so public. Remember-behind every federal crime, if followed to its logical source, is a lying liberal.

And Fitz's "investigation", at this point, consists of reading blogs and MSM for clues. Your tax dollars at work.

Chances are it won't get that far.

Were I Libby's Lawyer I would enter a motion for dismissal based on the fact that Fitzgerald withheld exculpatory evidence from the GJ baring that push for a quick trial. Don't let Fitzgerald use the new GJ against you.

IIRC a grand jury is used for two purposes (1) A GJ can compel testimony that an investigator cannot and (2) return an indictment against an individual (ham sandwich). I think that using a GJ to compel testimony against an indicted person is reprehensible since there is no cross examination allowed.
