Terri Schiavo is a "cerebral palsy-type victim" who deserves rehabilitation, and not a person in a persistent vegetative state who would want her feeding tube removed, her parents argued on national television.

Terri's father, Robert Schindler, stressed on Fox News Channel's "Hannity & Colmes" show that doctors told him it was "acquired cerebral palsy." Schindler blamed Terri's condition on her husband, Michael Schiavo, who has denied her rehabilitative therapy since late 1992, according to medical records provided to the Schindlers' attorney.

"Initially, Terri was talking. She was reacting and there were doctors way back when that said she could recover. And he stopped everything," Schindler said. "She has literally been in prison for four years. She's not permitted to go outside. She has no stimulation. She has a wheelchair that's broken that the husband will not fix."

As he has earlier suggested to WorldNetDaily, Schindler said he felt Schiavo had something to do with Terri's mysterious collapse in 1990 at the age of 26 that left her severely brain damaged and reliant on a feeding tube for nourishment.

"We have strong suspicions and we have evidence. And I really can't get into that as I'd like to at this point," said Schindler.

When pressed, Schindler repeated: "We have evidence."

"It's a matter of getting access to additional evidence that has been under lock and key all these years," he added, in reference to Terri's medical records from the early days of her injury 13 years ago.

Schindler referenced an investigation under way by The Advocacy Center for Persons with Disabilities. The non-profit organization is investigating abuse and neglect claims on the part of Michael Schiavo, some of which are outlined in a motion filed by the Schindlers which seeks to have Michael Schiavo removed as Terri's guardian.

Robert and Mary Schindler's live interview on the "Hannity & Colmes" follows a similar appearance by Mary Schindler and Terri's brother and sister on "The Oprah Winfrey show" Friday. WorldNetDaily reported the family has launched an effort to appeal to a national audience to swing the public-relations battle over their 39-year-old daughter.

The television duel started when CNN's talk-show legend Larry King devoted his hour-long program to Michael Schiavo's side of the story on Oct. 28.

WorldNetDaily has reported the Schindlers have been locked in a 10-year battle to keep Michael Schiavo from removing Terri's life-sustaining feeding tube. Michael Schiavo insists Terri does not want to be kept alive "through artificial means" and succeeded in getting a Florida court to order the tube removed last month.

Terri survived six days without hydration and fluids before Florida lawmakers and Gov. Jeb Bush intervened and ordered the tube reinserted. Schiavo has appealed the intervention on the grounds that it unconstitutionally violates the separation-of-powers principle of government, as well as Terri's right to privacy.

On "Larry King Live", Schiavo pulled no punches in expressing his animosity toward the Schindlers for consistently blocking his efforts to allow his wife to "die with dignity" and raising suspicions about his motives.

"They don't like me because they want the money," Schiavo told King, in reference to $1.2 million dollars awarded him and Terri in 1992 as a result of medical-malpractice suits over her brain injury. Schiavo claims the money has been used to fund therapy for Terri and only about $50,000 remains in her fund. WorldNetDaily has reported, Felos has been paid some $358,000 from the fund and Schiavo's other attorney reportedly received $80,000.

Fox anchor Sean Hannity asked the couple about Schiavo's assertion they were just after money.

"[Terri's adversaries] try to take the focus off of Terri – sort of accuse the accuser type of thing," said Robert Schindler. "We're defending our daughter. She has no attorney defending her, no guardian ad litem – which there should be – so it was left in our hands to defend her. And our family has been vilified for doing that."

Robert Schindler also asserted Michael Schiavo and his right-to-die advocate-attorney George Felos have shifted the focus of their public statements about the case away from the debate over Terri's current condition and placed the emphasis on her wishes. He suggested they did so because more than 150,000 people who viewed video clips of Terri, which the family posted on their website, e-mailed Florida lawmakers and Gov. Bush telling them they didn't believe the court ruling that Terri is in a persistent vegetative state, or PVS.

WorldNetDaily has reported that Terri breathes and maintains a heartbeat and blood pressure on her own. Although her vision is impaired, she can see and the video shown in court shows her tracking a balloon across the room. It also apparently demonstrates she can move her limbs on command, vocalize and respond to her mother.

Circuit Court Judge George Greer ruled Terri is PVS, based on the testimony of three neurologists who testified in an evidentiary hearing in November 2002. The neurologists, one appointed by Greer and two solicited by Schiavo's attorney, George Felos, testified Terri's apparent responses to her family members are random reflexes consistent with people in persistent vegetative states.

Greer also ruled that testimony by Schiavo, his brother and sister-in-law that she had casually told them a year before her injury she would not want to be kept alive by artificial means, was "clear and convincing evidence" of her wishes. Terri has no written mandate on the matter.

An appeals court upheld both of Greer's rulings.

"The strategy of [Terri's] adversaries – her husband and his attorney – changed after the videos came out. Now Felos is focusing on her wishes," Robert Schindler said. "In time, we'll prove that to be wrong too, if we're given the chance."

The Schindlers, including Terri's sister, Suzanne, and her brother, Bobby, do not believe Terri, who was a devout Catholic, wants to be starved to death, which would be the consequences if Michael Schiavo wins the fight to have her feeding tube removed.

"I'm going to follow Terri's wish if it's the last thing I do," Schiavo told Larry King.

Colmes: Florida courts are still battling it out over a new law signed by Governor Bush last month, that restored the feeding tube to Terri Schiavo...

Colmes: Terri suffered severe brain damage in 1990, when her heart stopped, cutting off oxygen to her brain. Her husband Michael, has been fighting Terri's parents for years, saying that his wife would NOT want to be kept alive artificially.

Colmes: Michael Schiavo had his wife's feeding tube removal last month, but Governor Bush stepped in and ordered the tube re-inserted six days later under the newly passed state law.

Colmes: Joining us now, to give us an update on Terri's condition, is Terri's mother and father, Mary and Robert Schindler. Good to have you both with us.

Schindlers: Thanks for having us, Thank you

Colmes: First ummm, Mr. Schindler, let me ask you first, how is Terri doing?

Bob Schindler: She seems to be recovered substancially, from the ordeal, ahh, she's still WEAK, but she's a... she's a FIGHTER, no doubt about it.

Colmes: Mrs. Schindler, let me ask you about this whole issue of a pecking order, and who gets to decide... you know, I guess according to the laws of most states, its always the SPOUSE who gets to decide on medical treatment. Should THAT be changed?

Mary Schindler: Absolutely. I think that umm, hopefully, you know, we can do something in that, after umm, we get our, life straightened out with Terri. We're going to try to umm, help the disabled, and you know, change some laws. Parents have NO rights at all right now,

Colmes: But what happens, I mean, you have a unique case... Are you saying in general, its better for the parents to make this decision, than a spouse?

Mary Schindler: No, I don't think that its BETTER for the parents, But I think that they should have SOMETHING to SAY, in what happens to their daughter. I mean they were married for 4 years, or 5 years. I've had Terri, you know... I HAD her, she was my daughter.

Colmes: Mr. Schindler, what do YOU think caused her injury?

Bob Schindler: Well, what the doctors are saying now, is that she's really a CEREBRAL PALSY type victim, in that she's become disabled from that, and its ACQUIRED cerebral palsey.

Bob Schindler: We have strong suspicions, we have evidence, and I REALLY at this point, CAN'T get into that, as I'd like to. But one of the, I think the strange phenomena is that ahh, what's happening NOW, you'll see the STRATEGY of Terri's adversaries has CHANGED, meaning the attorneys and her husband.

Bob Schindler: Where NOW they're concentrating on her WISHES. And BEFORE it was her CONDITION, the PVS. And there were 150 thousand people that contacted Governor Bush, saying she definately was NOT in a PVS condition.

Sean: Yea,

Bob Schindler: So... and that made the change. Thats what happened. And I admire the Governor for, you know having the integrity to stand up, and he, I'm sure recognized it as well.

Bob Schindler: So, what the spin NOW is, thats coming out of the ahh, her adversaries, is that her... these WISHES, and its ALSO coming out of the COURTS, its Terri's WISHES... and in time, we'll prove THAT to be wrong too... if we're given a chance.

Bob Schindler: No ahh, Its pretty obvious Sean, when you start piecing things together over the past years. She hasn't received ANY type of therapy... and, initially, Terri was TALKING, she was reacting..., and in that same timeframe, there were doctors WAY back when, that said she could recover with advanced therapy, and he stopped EVERYTHING on her. And she's LITERALLY been a PRISONER.

Sean: He went on some other show, and he wasn't challenged, and he just got to make this BLANKET claim, that YOU tried to make this ALL about money. Do you know what incident he was referring to? Do you know what he was even talking about?

Bob Schindler: Yea, I think what you're looking at is a SPIN there. What they do there, is try... and you're familiar in politics?

Sean: Sure,

Bob Schindler: They TRY to take the focus off of Terri. And its the old "accuse the accuser" type of thing. And we're defending our DAUGHTER. She has no ATTORNEY defending her. There's no guardian ad litem, which there SHOULD be, So it was left in our hands to defend her. And immediately, our family was VILLIFIED for doing that.

Mister Schindler, let me go back to you... I want to ask you this question about... you're getting medical opinions... COMPETENT certified medical opinions, that say that she CAN in fact, BREAK OUT of this state, correct?

Bob Schindler: That is correct.

Sean: How many have you got-

Bob Schindler: That's VERY correct.

Sean: What are they saying to you?

Bob Schindler: Oh ahh, everything is predicated on her, you know, getting the proper THERAPY. Which has been, you know, did not take place in her life for, God, 13 years. You know, she's been literally in PRISON for FOUR years. She's not permitted to go outside. She gets NO stimulation. She has a wheelchair that's BROKEN, and that he husband will NOT fix.

Bob Schindler: And let me add one more thing... There IS an investigation taking place right NOW... ahh, by an advocacy agency that... about the ABUSE that Terri's received. I think THAT investigation, when its concluded, will produce enough ahh... evidence to COMPELL the state attorney to conduct a CRIMINAL investigation.

Sean: Do you believe, he PUT her in this condition? We've discussed it in detail, Do you have, Mister Schindler, any evidence, to, to... cause I think this is important, cause thats such a heavy allegation to make... Do you HAVE any evidence, that can convince other OFFICIALS that in fact, he PUT her in this condition, or CONTRIBUTED to it?

Bob Schindler: Yea, well I TOTALLY believe that, yes. And we have evidence, and its a matter of getting access to, ADDITIONAL evidence, thats been under lock and key for all these years. And that has REALLY been withheld from us. And we NEED to have the STATE come in and INVESTIGATE it. And they will NOT. As of yet.

Colmes: Mister Schindler, why do you think that is? If you think you've GOT the evidence, and if its under lock and key, and if you can MAKE that proof, why do you think the state wouldn't be persueing it?

Bob Schindler: THATS a good question. We can't answer that.

Colmes: Mrs Schindler, Michael says, her husband says, that he tried desperately to find a cure, he tried experimental treatments in California ahh, planting electrodes in her brain to stimulate function, they took her Bradenton Florida to brain surgery specialists in a special facility, hired private duty nurses to take her on outings... Do you discount all of that?

Mary Schindler: No, not ALL of it. He took her to California. He took her to Mediplex. But after 1992, when the malpractice money came in, she hasn't had ANYTHING. She's been COMPLETELY isolated from ANY kind of therapy... ANYTHING.

Sean: Well, Mister and Mrs Schindler, we are glad, I am glad, that you got that ruling, that ahh, saved her life, and we wish you all the best in your struggle, and I'm sorry that you have to go through all of this. Thank you both for being with us, and we'll continue to update the situation.

The interview was good but too short, and there was way too much Peterson case stuff first! But the main thing is, it did help keep people aware of Terri's ordeal not being over yet!

Bob has recently acquired words like "spin" and "vilified". I think he should refrain from using these terms for two reasons:

1. It sounds like someone else's words being put in his mouth.

2. He takes away from his innocent charm and sweetness that has garnered so much support.

The fact that he avoided thinking ill of Michael for so long spoke volumns for his credibility and his belief in humanity. He needs to emphasize that he didn't allow himself to think the worse until the day of the fight and that even then he thought it might have been emotions running high. He has reached a clarity in his thinking, but he will do better to continue to express his regret that things have turned out this way.

The Second District Court of Appeals in Lakeland, Florida has lifted their stay in the case of Schiavo v Bush. Governor Bush is being given until 5.00 Wednesday, November 19, 2003 to complete his filings with the court. We will bring you more news as it develops.
