Hehe....Monday night is an odd time for a ZOT thread. They seem to hit more towards the end of the week...Friday mornings are quite common, so common in fact, that I got in the habit of having Zotted troll for breakfast on Fridays. .

Although its "contents" are not available for public viewing at the court, that doesn't mean it doesn't exist in the form and content as published in newspaper article.

Note: Felos did not deny what the 2001 newspaper "claimed" was in Terry Capone's affidavit (that MS fathered two children). Felos, instead, denied that Capone's statements were factual.

Sorry for the "tin foil hat" think but I am really beginning to wonder if Terri's brain scan was "switched" with one of a woman of the same age who is truely PVS and that she indeed may have more of a ceribral cortex that we are being allowed to believe. You have got to admit that the general fishiness of this case tends to promote this type of "tin foil hat" speculation.

Highly likely; it also shows that one must assume Felos continues to have contacts who can advise MS, as well.

Imagine my surprise coming home from work and the tube in my bedroom had the news on and I hear the local news channel talking about Terri etc. (whom they never said anything about every time I saw them talking on past occassions).. then they say that Oprah is going to be covering Terri's case on Friday at 4PM EST. I thought wow this might be good. But now that I went to her site I see that they are spelling Terri's name Terry and they are talking about Living Wills, etc. nothing about what is really going on. Then I join up on their message board and some woman is saying Terry already decided and her decision was to die. I for one am not going to sit idly by and not say anything so I responded but I think others may want to as well.

I went there, and this is what I posted, pc:

This is not true. Terri has no living will or other legal document stating anything about what her wishes are. She most especially did not leave any legal document or will which stated she would rather be starved to death than live.

The court has allowed Michael Schiavo's hearsay testimony be the "clear and convincing evidence" used to terminate Terri's life. The judge in question has refused to take into account statements made by Terri to her friend, Diane Meyer, while Terri was a young teen (Diane Meyer, recalled watching a movie about Quinlan in the summer of 1982 after they graduated high school. "I remember one of the things she said is, "How did they know she would want this? How did they know she wouldn't want to go on?"' Meyer testified.)

There are bone scans/x-rays performed on the night she "collapsed" which clearly show, according to the radiologist, fractures all over her body; a doctor has testified that damaged vertabrae in her neck are consistent with injuries which would be received by strangulation.

There is a great amount of other evidence that "Judge" Greer has refused to read/see. He admitted, under oath to an Appellate Court, that he ignored numerous doctors' sworn opinions and summarily rejected additional evidence that unmistakably proved Michael Schiavo lied to the court at the original trial.

"Judge" Greer did not read 6 of 7 doctor's reports stating that Terri was not in a PVS state.

There is more information that can be found simply by searching the internet rather than relying on the pureed, inaccurate baby food being fed by the news and certain shows.

It is really scary to me that such a large segment of the population of the United States of America could be working so hard at putting a woman to death who hasn't even committed a crime. Natural human decency says that if there is doubt, err on the side of caution, which is the side of life. This is beyond a matter of "doubt." It has become a matter of willful determination to kill, in spite of overwhelming doubt!

"Dear Oprah,

I read that you will be doing a story about living wills this week? I guess you will be making reference to the Terri Schiavo situation. This is an important topic, but you would be better served doing a show about Terri.

I also read that someone with you show had the gall to state that it is Terri's wish to die. You really have made a conscious choice NOT to educate yourself about her husband, the weird attorney Felos and others wrapped up in a case where conflict of interests have decided she must die.

You are irresponsible in not promoting a proper story. Why on earth would you even mention Terri.

I am posting my message to you on FreeRepublic.com and urging the masses (we have considerable clout) to boycott your show, magazine, and ANYTHING you promote and are affiliated with (sponsors, etc.). When you are going to stand up and be independent of other media outlets that have committed horrible journalistic malpractice in the case of Terri Schiavo?

Oprah, you stink!"

Have you seen the House Amicus Brief filed by Rep. Byrd (defending the constituionality of Terri's Law)? Posted here.

It's really quite elegant -- makes the case for constitutionality of the legislature's actions quite nicely. Two points I found interesting:

1) The power of the court to make life or death decisions in cases like this is NOT stautory. Rather, it was set out IN DICTA (lawyerspeak for "an aside in a court decision, which generally doesn't have the effect of law") in the Browning decision. (yes, that's the same Browning)

and

2) Subsequent to the Browning decision, FL statues were revised to provide for the GUARDIAN to make life/death decisions. But in Terri's case, the decision HAS NOT BEEN MADE by the guardian -- instead, it has been made by JUDGE GREER, pursuant to the dicta in Browning. And this violates the express provisions of the current FL statutes..
