Catholic Care Loses its Five-Year Legal Battle [Against Homosexual Adoption-UK]
The Catholic Herald (UK) ^ | 11/2/12

The adoption agency Catholic Care has lost its five year fight to reserve its services for heterosexual couples only, in a landmark court ruling.

The adoption agency based in Leeds, had taken its case to the Upper Tribunal in order to win the right to maintain charitable status while being permitted to refuse to place children with same-sex couples, in accordance with the charity’s Catholic ethos.

However, they were defeated today as the Charity Commission argued that the charity’s stance is “divisive, capricious and arbitrary” and undermined the dignity of homosexual couples whose parenting abilities are “beyond question”.

The tribunal concluded that Catholic Care had failed to come up with “weighty and convincing reasons” as to why the agency should be allowed to discriminate against gay couples who were trying to access their services.

Emma Dixon, who was representing the Charity Commission, told tribunal judge, Mr Justic Sales, that Catholic Care’s desired arrangement would violate Article 14 of the European Convention on Human Rights, which outlaws discrimination on the grounds of sexual orientation and other characteristics. She said: “A requirement to operate within the tenets of the Church cannot constitute Article 14 justification.

“To do so would be to offer protection to the substance of the Church’s belief that homosexuality is sinful.

“To do so would not only be divisive, capricious and arbitrary, it would be excluding from assessment couples whose personal qualities and aptitude for child-rearing are beyond question.”

My advice to them, shut down. These scumbags don’t want your help, don’t offer it. It’s not worth violating your conscience. This kind of thing is why Europe is in a death spiral. I thank God that there is a palpable backlash against the homosexual agenda in Greece. Hope that it spreads.

"divisive, capricious and arbitrary"

textbook projection.

Can they continue to place adoptions without "charitable" status? If so, they should continue.

if not, then they should go underground. There is probably a way to have women who don't wish to abort designate the adoptive parents. The church should care for these women and have them designate Catholic foster parents as the adoptive parents.

"undermined the dignity of homosexual couples whose parenting abilities are “beyond question”.

This was the only finding in the entire opinion which was unquestionably "capricious and arbitrary"

To me, an interest group’s “parenting abilities” whatever that means, is not relevant.

What is in the best interest if the child should be predominant.

Furthermore, does the EU human rights declaration have a clause on free exercise of religion?

Curious. England was perhaps more responsible for spreading the Christian (originally Catholic) idea of freedom throughout the world than any other country, yet there have long been maggots among their thinkers as well. Karl Marx retreated there to write his influential works. Communists and progressives have been influential there for 150 years. And now, finally, it looks as if the England we have known and admired is pretty much dead.

There has always been an anti-Catholic streak among the English, but more is involved here than that. The traditional values are dead, dead, dead, after a brief revival under Maggie Thatcher—who was shoved out of office by her own Conservative Party.

The Catholic Adoption Agency is not saying homos can’t adopt, they are just saying THEY don’t want to participate

There are plenty of other places they can go withouth forcing their beliefs on someone else

You're absolutely right. If they don't shut down you can bet your bottom dollar that when horror stories of child abuse that are the the inevitable consequences of this start to come out a few years down the road the media will find some way to blame it on the Catholic Church rather than the queers who adopted the children.

Listening to the psychiatric experts and allowing "celibate" queers into seminaries didn't work out and neither would this if they remained a part of the adoption process in the UK.

Ahhh, my FRiend, you’re missing the point.

It’s not enough for them to live out their perverted fantasy, they want to force your participation or put you out of business or in jail.

I have to admire Russia for their commitment to Christ, especially after decades of leaders who tried to turn the country to atheism. Christianity is even growing in China, whereas it’s dying a slow death in Europe. Depressing. No wonder Europe’s going to shit.

The Russian word for Sunday is Воскресенье, pronounced, Vos-kreh-SEN-yeh. It means "Resurrection". The soviets tried to change the name of the day to a number, without success.

"undermined the dignity of homosexual couples

They have no dignity ... buggery and similar unnatural acts are inherently undignified.

Absolutely. And I believe they know, in their hearts, that what they do is obscene. That is why they strive so hard to receive society’s approval in order to convince themselves that they are somehow normal.

Several questions are now created.

Since they can no longer provide adoptions in the UK, can they “offshore” their adoptions? That is, provide them through another EU or non-EU nation.

One way of doing this would be to offer dual citizenship to orphans through Vatican City, which is diplomatically the same as a nation. The Vatican is technically a microstate and not part of the EU.

The Holy See’s Nunciature to Great Britain is the diplomatic post of the Holy See whose representative is called the Apostolic Nuncio to Great Britain with the rank of an ambassador. The office of the nunciature is located at 54 Parkside, Wimbledon Village, London.

Thus this would involve setting up a “Nunciature annex” that would exclusively deal with avoiding the oppressive UK government. Thus Vatican dual citizenship and adoption to British parents, and anything else the British regime outlaws that is oppressive to Catholics.
