In my understanding, the conviction can be retained, so long as he's not sentenced to more than he would've been sentenced had the boy been a girl. Since the maximum sentence he would've received in that case is 15 months, and he's already served three years, then he will be released on time served - with the conviction.

It was the sentence that was vacated.

That would be greatly appreciated! I seem to recall the decision differently than you do, but I could be wrong because my exposure to the news was barely more than 'in passing', so to speak. But I seem to remember agreeing with Ginsburg (Aaaahhhh!), and combined with the fact that the ruling went along gender lines are the only reasons that I actually remember it. Please let me know. No one has claimed this case has anything to do with consenting adults ... the kid was hit for stat-rape. As he should have been. However, 17 years is a bit much. This kid will not get off free, but probably be released on time served. 3 years is pretty reasonable, even harsh.

I won't be so bold as to say that all vegans are homosexuals or that all homosexual are vegans, but there are vegans who are also homosexuals.

I've met and overheard a number of vegans who slip up (their temptation is Texas barbecue). There are those who do not slip up though.

It's funny that people can learn to control their desires for foods that whet their appetite but not control their desires for mates that whet their sexual appetite. And this is a voluntary control, they face no legal judgement.

Just because adults are going to try to engage in sex with minors does not mean that such actions should be tolerated. If there is a deficit in the law, shouldn't the age of consent be normed upward to eliminate the problem instead of defining the problem downward?

It's that slippery slope thing we talk about.

If she was 14 and you were 18 ID have you arrested. And if you got 3 years I'd find it appropriate. If she were 14 and you were say 40, I might just shoot the perp ... might, maybe, perhaps, in theory.
