Thank you for clarifying that. How does that work, i.e., did the Republicans file suit in the higher court, claiming the need for the expedited timetable, or was it the Rats who appealed to the higher court? Sorry to be such a pest, but I'm trying to learn.

Pubbies are preparing their case to the SCOTUS as we speak. If SCONJ rules in our favor, the case is over...and the law is upheld.

If the law is struck down or set aside by the SCONJ, Forrester et al will already be prepared to file a petition for the SCOTUS to intervene.

They would probably recieve an instant injunction for NJ to NOT process or change any ballots until the issue is decided.

T Lott already has said this will go to the SCOTUS if the SCONJ sets aside the law.

Fun... it sure is. It is Fun Fun Fun 'til her Daddy Takes The T Byrd away.... but I date myself ... and Senator Byrd too.

I will tell you somthing that Alben Barkley told my dad and I way back in 1951. There are no permanent political friends. There are no permanent political enemies. There are just people with common interest who will work together for a common goal..(long pause).. if the price is right and the payoff is good enough. The veep was a realist.

Daschle Gephardt, McAulliffe among others are very concerned about losing the Senate. They knew the Torch was going down. The internal polls showed it big time. They have to get the Torch to drop out so they can run someone who can win. The poll some names. The polls show Lautenberg can do it.

But how to get the Torch to give up the ghost or at least his place on the ballot? That is the question. The deal was dictated by Torch. This is how it is done. Daschle calls Torch in last week and asks what will it take? The problem for the Daschle crew was the Torch was in the drivers seat with the top down and the radio turned up. Only he can resign and they have to assure him of something to make him do it. What did they offer him,Torie? Two Rolexes and a time piece to be named later? I don't think so. A chinese guy already did that. You don't really think that the Torch's poor little feelings would have been so very hurt if he stayed in and lost do you?

The torch is no idiot.. He said here is what it takes. You put it together or I stay on the ballot. It took quite a while to get it done. Lautenberg did not want to do it. We have to show the N.J. Supreme court justices a couple of neat pictures (How did you get her to do that your honor?) and a few other details ... but it was done.

That is what is happening Torie.

Perhaps we could get Senator Byrd arrested for driving while sober.... Maybe we could approve some Judges while he is in the tank. We know they won't arrest him for driving while drunk.

Why does that make a difference? This is a Statewide election, not a National election. I hope I am wrong or that the SCONJ is law-abiding, but I don't understand the SCOTUS involvement in this?

Because the election involves a federal office (senator), depriving someone of their vote becomes a federal issue that SCOTUS can review. If they change the ballot after some people have already voted, then that is unequal treatment under the law, and a cause of action that SCOTUS can address.

You don't really think that the Torch's poor little feelings would have been so very hurt if he stayed in and lost do you?

This is what has been bothering me all along; he cannot possibly be that vain, can he?

Something else is going on here; the judge on Fox News says this has been going on since last Friday; I just cannot understand WHAT they hope to accomplish.

Whatever their internal poll numbers are, they must be worse than even we can hope!

No, not at all. Under NJ law, a party cannot legally replace a candidate after the 51 day deadline has past. There is nothing whatever in the law about a court ruling being allowed to overrule this. They are flat violating the law. But they don't believe in the rule of laws, they believe in the rule of judges acting as little tyrants and ordering whatever they darn well please by fiat - see the SCOFLAWs of two years ago.

No judge has the authority to rewrite the statute to suit the partisan interests of the democratic party 35 days before the blessed election. No judge has the authority to write NJ law - only the legislature does. Doesn't anybody else see the ridiculousness of throwing out the very idea that laws matter for the sole purpose of finessing the election of a legislator? Who the heck cares who is elected to legislative office if they laws they pass are completely meaningless? In a dictatorship of judges, legislative elections won't matter a damn.

It is beyond desperation. It is a mockery of both law and democracy. What happened to open primaries? What happened to black letter state law? They don't give a damn. A lower court having original jurisdiction? Why, that would just get in the way by reading the statute and revealing they haven't a leg to stand on. So the Comintern of NJ orders the Politburo of NJ to approve the substitution. Hell, why have an election? Why not just have the Politburo declare the democratic party's favorite candidate wins, whatever the voters say? They ignore the votes needed in legislatures to change laws, why not ignore the votes needed in elections to elect legislators?

Right. The judge's role is to decide whether someone's action comports with the law, not to rubberstamp an outright violation of it if he, the judge, believes the violator had good enough reasons.

I feel reasonably certain that the NJ SC, unlike the Fla SC, will not muster a bare majority of hard-left Dems who will throw the law out the window in an effort to aid Lautenberg (the 78-year-old, drooling, would-be substitute for the Torch). I expect a split decision against the Dems within 3 days.

Then perhaps the Torch will resign from the Senate and the Governer will appoint Lautenberg, attempting to make that stick until 2004. But the 2002 election will still be held, and two (count 'em, TWO) people will show up at the Capitol to be seated as NJ's new Senator. The 99 other Senators will then pick one.

That means the Torch, who will have resigned from the race and then from the Senate, will be a NATIONAL issue for all Senate candidates, now.
