I just realize you are an LEO...maybe these questions are in your line of expertise...

What would be the reasoning that allows a "fleeing" person to obtain safe harbor ?

Would it not be in the best interest of the LEOs and public to isolate the fleeing person away from possible weapons and innocent persons(future hostages) ?

I realize we don't have all the details on this case and the answers are not that easy, but I am interested. It seems in quite a few of these cases turn into a barricade situation and the ultimate death of parties on either side.

I think that alot of these people should not be out in society, living on their own because they are not capable of doing so.

IN the 70's and 80's there was an "advocate" movement for the mentally ill which effectively made it impossible to have someone committed against their will. The general argument was that involuntary committment was a violation of due process and the 4th Amendment. Hundreds of state mental hospitals were closed in the 80's.

So now we have the "homeless" (40 percent of whom are mentally ill) and examples like Andrea Yates and this poor codger, none of whom can be committed without extreme legal measures. Sometimes they become a nuisance to others, and sometimes murderers and worse.

The core problem here is the gross insistence by liberals that people who cannot think or act rationally be able to exercise their "due process rights." And here we have yet another sad testament to that "freedom."

Precisely. Those cops should be in a high security prison for the criminally insane, not running around our streets executing senior citizens for barricading themselves in their homes.

Well, one thing I can tell you about police pursuits, the public doesn't like them and police dept.'s are changing their policies regarding pursuits.

For instance, our own pursuit policy recently changed. They may as well take the flashers and siren off our our cruisers. If the guy is not known to be a mass murderer we don't pursue. And it's getting to be like that nationwide.

Wait until everybody finds out that the police wont chase you if you run. Nobody will be pulling over. Then, the dept. expects the officer who attempted to stop the car to do the follow up investigation. It ain't worth it. Alot of guys are just not going to stop cars.

Kind of like creating a "police free" zone...similar if not the same as "gun free" zones we have in some public areas...

When criminals know you have no recourse nothing will stop them.

Although I don't agree with the result, I wouldn't blame them. Following up might just find yourself walking into an ambush...

He was a 69 yr old man with no reported history of violence who barricaded himself in his home, armed with a sword. He could have been peacefully apprehended by WAITING. But no! Your Masters didn't have the intelligence to do anything more than pull the trigger as early and often as possible. Gas? An armored car? Fully automatic military weapons? Opening up on him in tune with the cheering of his neighbours? All to dispatch a sr. citizen allegedly armed with an alleged "sword" who had committed the sin of "DRIVING TOO SLOW". It's sickening.

LOL, reminds me of when we went to an Indians baseball game. In between innings on the scoreboard they had a question posted: 'Ginger or Mary Ann?' Then it showed the Indians players giving their answers.

Ginger won but it was closer than I thought it was going to be.
