This is a civil case, not a criminal case. Though they are taking criminal actions e.g. civil forfeiture and trying to place the assets in receivership to be sold. I don’t see that standing up on appeal. And the precedent is extremely dangerous if it is upheld.

In this case it has to go up for appeal to a federal court, which then has to use the Constitution to overrule the state court. Hopefully Trump’s team can get a stay from the lower court pending appeal, or, an injunction from a federal court given the irreparable harm that would ensue if the NY court were allowed to simply strip him of his properties because of a dispute over the valuation.

President Trump was on Chris Salcedo’s show saying that the judge, I think, decided to remove some of the language in the case concerning STATUE OF LIMITATIONS.

I am pretty sure that the Judge reversed himself.

President seemed pleased.

Question. Assume that the judge rules Trump committed fraud. The bankers do not testify or sue Trump over this issue, mainly because the loans were paid back, but fraud is fraud. So the question…..

If you are a share holder of the bank and the judge said there was fraud but the banks never went after Trump. So as a share holder could you sue the banks in a Shareholder Derivative Lawsuit? After all you have a judge’s ruling and the bank not do anything to prevent or recover because of the fraud.

That's what I've been wondering about as well. New York is not business friendly, definitely not Trump friendly. He should cut his losses, sell, and move on.

And on his way out, Trump should call for a boycott of any dealings with anyone or anything in New York. Make it hurt.

Its pure nonsense. There was no financial damage to any bank. They made loans that had all the typical terms and conditions (its called a contract) which were satisfied. No breaches. No late or missing payments. The banks got what they bargained for in the deals. Case closed.

Same logic that they are using on a Trump and if a Judge rule fraud then it’s fraud. See how that works! So why not spread the pain and make NY a business Desert. Give them the Cortez treatment, burn baby burn. Make NY toxic to business! That kills taxes and kills government.
