FR: Never Accept the Premise of Your Opponent’s Argument
Corrupt Congress ignores what the people want, Biden now asking people to pressure Congress to do what the people don't want.
A big part of the problem with respect to how state and federal governments should deal with domestic gun violence is this imo. Many states seem to think that the federal government has a "magic wand" to come up with better remedies than the states can for any problem that the states may have, possibly all the states clueless that they have never expressly constitutionally given the big, bad feds the specific power to make peacetime restrictive gun laws.
More specifically, the descendants of the immigrants who pioneered the USA are still treating the federal government as the absolute leaders that their ancestors left behind when they moved to US imo. This idea should not be surprising since the states have foolishly never required citizens to pass a basic constitutional law test that emphasizes the federal government's constitutionally limited powers before being allowed to vote.
It follows that the 16th and 17th Amendments effectively repealed the founder's vision of a constitutionally limited power federal government imo.
Getting back to the misguided idea that the federal government somehow has the best wisdom for dealing with gun violence, the drafters of the Constitution had actually expressly required the untrusted federal government to STAND DOWN to domestic violence, unless a state formally requests assistance from the feds to help suppress the violence.
"Article IV, Section 4 (4.4): The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence [emphases added]."
In fact, Justice Joseph story had clarified that the reason 4.4 was made was to keep the untrusted feds from dreaming up any excuse (my words) to interfere with the affairs of the sovereign states.
”§ 1819. It may not be amiss further to observe, (in the language of another commentator,) that every pretext for intermeddling with the domestic concerns of any state, under colour of protecting it against domestic violence, is taken away by that part of the provision, which renders an application from the legislature, or executive authority of the state endangered necessary to be made to the general government, before its interference can be at all proper [emphasis added]. On the other hand, this article becomes an immense acquisition of strength, and additional force to the aid of any state government, in case of an internal rebellion, or insurrection against its authority. The southern states, being more peculiarly open to danger from this quarter, ought (he adds) to be particularly tenacious of a constitution, from which they may derive such assistance in the most critical periods.” —Joseph Story, Commentaries on the Constitution, Article 4, Section 4.
The Supreme Court has also emphasized that the purpose of the 2nd Amendment (2A) was to officially constitutionally recognize the federal government as a possible enemy of the people (my words).
"The second and tenth counts are equally defective. The right there specified is that of "bearing arms for a lawful purpose." This is not a right granted by the Constitution. Neither is it in any manner dependent upon that instrument for its existence. The second amendment declares that it shall not be infringed, but this, as has been seen, means no more than that it shall not be infringed by Congress [emphasis added]. This is one of the amendments that has no other effect than to restrict the powers of the national government, leaving the people to look for their protection against any violation by their fellow citizens of the rights it recognizes, to what is called, in The City of New York v. Miln, 11 Pet. 139, the "powers which relate to merely municipal legislation, or what was, perhaps, more properly called internal police," "not surrendered or restrained" by the Constitution of the United States." —United States v. Cruikshank, 1875.
In my opinion, not only have the states never expressly constitutionally given the corrupt feds the specific power to make peacetime, non-militia-related, restrictive gun laws, but the Court's clarification of 2A in Cruikshank means that the amendment protects citizens from having to let the feds know anything about their personal firepower, or qualifications to use that firepower, actually state power issues now limited by 14th Amendment (14A), if we had a respectable Congress that actually did its duty to enforce 14A personal protections.
Patriots, the bottom line is this imo. What is your threshold of “pain” for peacefully stopping unconstitutionally big state and federal governments controlled by bully, constitutionally undefined political parties, from oppressing the people under their boots?
The inevitable remedy for ongoing, post-17A ratification, corrupt political party treason (imo)...
All MAGA patriots need to wake up their RINO federal and state lawmakers by making the following clear to them.
If they don’t publicly support either a resolution, or a Constitutional Convention, to effectively "secede" ALL the states from the unconstitutionally big federal government by amending the Constitution to repeal the 16th (direct taxes) and 17th (popular voting for federal senators) Amendments (16&17A), doing so before the primary elections in 2024, that YOU will primary them.
If the proposed amendment was limited strictly to repealing 16&17A, relatively little or ideally no discussion would be needed before ratification of the amendment imo.
With 16&17A out of the way, my hope is that Trump 47 becomes the FIRST president of a truly constitutionally limited power federal government.
In the meanwhile, I'm not holding my breath for significant MAGA legislation to appear in the first 100 days of new term for what may still prove to be another RINO-controlled House.
In other words, primarying RINOs in 2022 was just for practice. Trump will hopefully do another round of primarying for 2024 elections.
But Americans, both left and right, like their guns better than they like Uncle Touchy, so how’s that gonna work?
