What about the precedent that existed for hundreds of years before Roe? That it was a state matter? How is Roe a precedent and that isn’t??
My thinking is it was 5-4.
For: Thomas, Alito, Gorsuch, Kavanaugh and Barret
Against: Roberts, Bryer, Kagan, Sotomayor

If Alito has made the judicial case that Roe was bad law, and they concur, then nothing they said to Collins would be contradicted by their decision. Alito simply said that the precedence was based on an unsubstantiated and unjustified interpretation of the Constitution and the context of case law that it was based on.
However, RBG said that Roe was wrongly decided. Not because she was against abortion, she just didn't think it was the right way to do it.
