Correct. If he we were a candidate for office campaigning in a church or was encouraging the congregants to vote a certain way, the church should lose its tax exemption. (Not that it will ever happen, especially with black churches.) That's a tax code issue rather than a constitutional issue.

He loved all of those things when they were working for him.
And that is exactly why he resigned for the reasons he resigned. They knew they couldn't do the standard deal of Cuomo resigning to avoid prosecution for the nursing home deaths, so they got him to resign for sexual harassment. In exchange, he wouldn't get prosecuted for the nursing home deaths because that would be too much of a scandal for the RATS since it would go nationwide against other RAT governors.
Oh, and they would drop all the sexual harassment charges along the way which they've done. Now, Cuomo just needs to play the part of aggrieved cancel culture victim to ensure the focus stays off the nursing home deaths with the midterms coming up.

Koch was one of the few Democrats I actually had some respect for.
The only legitimate thing Cuomo could possibly say to gain acceptance that his resignation was bad was that his successor is arguably a worse governor. But he will never convince anyone it was unwarranted.
