LOL, like this is new. Started with the Marshall court and peaked in 1973. This isn’t new it is Standard Operating Proceedure. As if Ginsberg every worried about the letter of the law or restrictions spelled out in the Constution. Leftist judges rule by seat of the pants fiat. They just make it up as they go, as long as it aligns with their political philosophy.
