If you have a large tree on your property that you know or should know is dead which blows down during a storm and kills someone, you are going to be held liable.

If there was in fact a requirement that the gate be secured - presumably to protect against this very thing - and it was not secured the US could certainly be held liable (subject to a potential sovereign immunity defense, however).

Good catch. Yes, if the park was closed they were trespassers and the Park Service owed them no duty of care.

“The family says under federal park rules, similar gates should be secured, but the gate that struck Ms Nakajjigo had been unlatched for weeks, Fox 13 reports.

The family’s lawyer Deborah Chang said the gate struck the car so suddenly – and was so well blended into the surrounding landscape – the honeymooning couple had no chance of avoiding it.

Ms Chang described the part of the gate that struck Ms Nakajjigo as being like a “metal spear or a lance” and hit the car in “literally a split second”.”


How do they know it was unsecured for week?
Was there a sign up indicating the park was closed?

A lot of swing gates can be locked in an open or closed position. (Or possibly secured unlocked in an open position.) The fact that it was unsecured in either position argues that someone removed the lock and pitched it. Unless there was some kind of guarding mechanism like you find in a shed securing mining explosives, then anyone with a large bolt cutter could have removed the lock and left it open.

A Motorcycle gang having a party, off-roaders or R-Vers or anyone disappointed in the lock down could have showed up at the gate and in possession of bolt cutters.

The Park Service might want to do a search in the area and see if they can find whether a cut lock is somewhere within throwing distance.

They might also want to go back and see if people emailed complaints about the gate being locked when they went to visit, or social media that shows the same thing. Might also search and see if someone admitted to breaking in and posted pictures or something.

If there was a log book for peoples comments somewhere around the gates they might also check to see people were disappointed that the gate was locked when they came.

They probably wont though. Easier for Govt. awyers to just do a payout with the peoples money.

I remember traveling through Arches back in the 70’s. I do not recall ever seeing a visitor center, Gates, signs,crowds of people or even paved roads in some places. I do remember awesome silence, fantastic landscapes and natural beauty. I don't think it's the same today. I'm glad I saw it before it became a "destination".

All good points.

If the park was open to the public, the victim would probably have the status of "invitee" under the law. A property owner has a duty to make the property safe for invitees, which includes conducting a reasonable inspection of the premises to uncover hidden dangers. If the Park Service doesn't have a trespasser or sovereign immunity defense, this may be a tough case for them on the liability issue.

Sounds like he drove into it from this article HERE, the other article left out the part I highlighted.

I am having a hard time imagining how a car gate could decapitate a woman and not the other person in the car.

To decapitate, the gate would have to go sideways, no?

They are focusing on the “next oprah” thing like it’s written in stone and it’s more tragic because she was going to be someone famous than if it happened to some nobody.
