Man charged with firing handgun just before alleged Kyle Rittenhouse shootings
A man has admitted being first to open fire at the Kenosha protests in the moments before accused teen gunman Kyle Rittenhouse allegedly shot and killed two people and seriously injured another, according to court documents.
Joshua Ziminski, 35, and his wife both admitted to detectives that he fired off a warning shot into the air during the Aug. 25 protests in Wisconsin, according to a criminal complaint obtained by The Post.
Attorneys for Rittenhouse have called the gunshot a pivotal moment that left the 17-year-old alleged militia member fearing he had no way out as he was chased by protesters with no way to know who fired that shot.
On-the-scene reporter Richie McGinniss has also said the sound of the shot was the moment Rittenhouse went from running away to aiming his weapon in what the teens attorneys insist was self-defense.
Ziminski was investigated by the same detectives assigned to probe Rittenhouse and the now-viral videos of the killings, the complaint said. The 65′ Wisconsin native was seen clearly holding a black handgun at large groups of people just before the attack, the officers detailed in the complaint.
Ziminski was also seen with wife Kelly walking toward the Ultimate Gas Station lot with his arm pointing the gun upward towards the sky, the document said.
Detectives observed a muzzle flash emit from the handgun, and heard a gunshot at the same time, all backed up by another video clip, the court papers said. Several other people are in the nearby vicinity when the defendant fires the handgun, the documents said.
After Ziminski and his wife both admitted that he had fired a warning shot into the air, they then claimed they could not produce the gun because it had been stolen from their home, the complaint said.
Ziminski was booked last Wednesday on charges of disorderly conduct and use of a dangerous weapon, online court records show. He pleaded not guilty during a virtual hearing Friday, and released Friday on $1,000 cash bond, with conditions barring him from having any weapons or discussing the case with his girlfriend, records show.
A pre-trial hearing is scheduled for Dec. 4.

Anyone who has watched lots of these videos knows what is shown in your left picture, that this man who fired a shot in the air appeared to be an associate of the man who charged at kyle, if not good friends. There is a long confrontation video well before the shooting at a gas station, where they stand together and seem to be together.
It is not out of the question at all that the charge and shot in air was part of some plan they had made together, perhaps the shot in the air was some kind of signal to him or other comrades.
Of course it was. How much jail time do you get for evidence tampering again?

Moral of the story... Never scare the hell out of someone that’s carrying a rifle. It can end up really bad.
Either that or It must have been a tragic boating accident..............
Wife or girlfriend?
Maybe I am just old fashioned but the report says he and his wife were at the scene, but the ending says he is not allowed to discuss the case with his girlfriend.

Warning shots, as commonly referred to, are from a threatened person toward the threat, in an attempt to ‘warn’ him . . . . to cease, depart, etc.
In real situations, as I understand, warning shots are not a good idea. Both in terms of the threat, and in terms of the law and charges after the fact.
So the media threw out ‘warning shot’ to shape the narrative.
Probably was a signal shot as already suggested. From an itchy trigger finger who was hyped, and maybe wanted an excuse to shoot someone.
