Ted Cruz Explains Perfectly Why RBG's Seat Must Be Filled Before the Election

Republican Senator Ted Cruz says President Donald Trump needs to nominate a successor Supreme Court Justice Ruth Bader Ginsburg next week, and that the Senate should confirm that choice or the country risks a constitutional crisis.

“I believe that the president should, next week, nominate a successor to the court. I think it is critical that the Senate takes up and confirms that successor before Election Day,” Senator Cruz told Sean Hannity on Fox News.

“Democrats and Joe Biden have made clear they intend to challenge this election. They intend to fight the legitimacy of the election. As you you know Hillary Clinton has told Joe Biden ‘under no circumstances should you concede, you should challenge this election.’ and we cannot have election day come and go with a 4-4 court.”

Cruz continued, “A 4-4 court that is equally divided cannot decide anything. And I think we risk a constitutional crisis if we do not have a nine-justice Supreme Court, particularly when there is such a risk of … a contested election.”

Cruz then shared his experience litigating Bush vs. Gore case and how the country didn’t know for 37 days who the president-elect was. “I think we have the responsibility to do our job. The president should nominate a principled constitutionalist with a proven record and the Senate … should do our job and protect the country from the constitutional crisis that could result otherwise.”

Elections have consequences. Judicial appointments are, at their core, political. When you have a Republican President and majority Republican senate, you get to choose nomination timing and who will sit on the Supreme Court. When Merrick was named by Obama during a presidential election year, he would be sitting on the SC now had he had a Dem senate. He didn’t. He loses. Simple as that. Dems would do it too. They even go a step further in threatening to pack the court as their backup legislature when they return to power. Spare us the faux virtue fantasy in denying the reality that the judiciary at its highest level is immune from the political realm when it comes to cases involving political public policy. Dem appointed justices confirm such is the case by historical straight party line votes from the bench. It is what it is whether we like it or not.

Pipe dream. It’s a 5-3 court, notwithstanding Roberts’ occasional unreliability.

Look, Cruz knows this. He’s on the Judiciary committee. But he also knows that the committee is chaired by the even more unreliable Lynnzie Graham and its R majority includes the ever commodious Grassley and the turncoat Sasse. That nomination will stay in committee while they dig up false charges vs the nominee. The D side of the committee includes Pat Leahy, Dick Durban and Kamala Harris. Don’t even try to tell me that this won’t be a media circus that will go on amid cries of rank injustice.

5-3 on the Court: I’ll take those odds.

Cruz nailed the MAIN reason we need that seat filled before the election.
The SC WILL BE called upon to sort out the massive voter fraud(Mail In Ballots)
in key battleground States.
And filling this seat before the election is of extreme importance.
Much more than the objections of a few RINO Senators.
These RINOs can either confirm Trumps nominee.
Or go down in history for killing off the GOP.
And their no vote will kill off the GOP...forever.

The CRUZ 4-4 Constitutional Crisis argument is very strong and, for me at least, is decisive.

Trump should name his candidate, make a very big deal out of the widely reported Dem plans for post-election litigation and then explain the disaster of 4-4 No Decision Supreme Court scenario to the people. We need a 9th judge and we need her now.

Despite what Biden claimed, Obama’s nominee was not brought up for a vote in 2016 because that was his last year in office, the year he nominated Garland, and no president has had his nominee approved under that scenario with an opposition party controlling the Senate since the 1800’s and Republicans controlled the Senate in 2016.

This is not currently the case for Trump as the President and majority Senate are now of the same party. Therefore Trump gets his pick and Obama doesn’t! Too bad for Dems. LOL.

Based on the political calculus I would put my money on Barbara Lagoa as the choice, perhaps not my favorite choice, but a Latino. Whare are the dems going to do to attack her. The more they fire for effect, the more they will piss off the Hispanic vote.

I love Barrett, but she is less circus resistant, and doesn't really bring in a new constituency.

So Sen. Murkowski seems to be saying “Oh,dear, I don’t know, it sounds so unfair to the Democrats to be strong in our principles like that. I’m getting shivers of fear that I’m being harsh to them.”

Cruz is right but I do worry about people like Romney and Murkowski in the Senate. Can’t exactly depend on them to do what is right.

For the quickest possible confirmation of a conservative to the USSC, perhaps Trump should nominate Ted Cruz, who he just added fo his list a few days ago.

Cruz is a well-known figure already to the public and to his Senate colleagues. Of course, the Dems are going to fight the nominee no matter who it is, but I think this puts Trump in the best position to get the seat filled by a solid conservative Constitutionalist.
