Stockman Conviction a Roadmap for Biden/Harris to Jail Conservative Activists

Former Congressman Steve Stockman, whom leftwing Salon called a “Tea Party darling,” has asked the U.S. Supreme Court to hear his appeal from a 10-year criminal sentence on multiple counts involving raising money from just two GOP donors.

You may have heard the term “criminalization of politics.” Steve Stockman’s 2018 conviction is very literally an example. Stockman’s asking the Supreme Court to overturn that politicized conviction should be watched by conservatives who know that a Biden/Harris administration would be a reboot of the lawless and lawbreaking Obama Deep State, but probably even more vindictive towards conservatives.

Former prosecutor Rachel Alexander, writing at Townhall.com, said of Stockman:

He was a Congressional whistleblower on Obama administration corruption, with such actions as calling for the House Select Committee to investigate the government’s handling of the Benghazi… exposing President Obama’s payment to the Haqqani terrorist network in exchange for the release of Army deserter Bowe Bergdahl, and revealing Secretary of State Hillary Clinton’s violation of the Iran sanctions to allow the sale to Iran of specialized steel used in nuclear weaponry.

Stockman was visited by the FBI within a few days after calling for the arrest of the notorious anti-Tea Party IRS official, Lois Lerner, who was abusing nonprofit tax law to silence conservatives, and acting in contempt of Congress. Those very nonprofit tax issues abused by Lerner would later be corrupted as a way to prosecute Stockman. The judge in Stockman’s trial even refused to let Stockman’s defense mention the name “Lois Lerner.”

The Department of Justice empaneled three grand juries to indict Steve, including one out of the Baltimore office run by Spygate figure Rod Rosenstein, but all three failed to indict.

I think Stockman is a little “fringe” but he would probably fit it pretty well on Free Republic. I consider him a good guy and I think the Left railroaded him. The Left owns the Justice system and they seem to be able to railroad anyone they want.

That describes Obama in a nutshell. I warned people about that guy; he was the creation of the corrupt media and hard left apparatchiks. Deep State all the way. A Manchurian candidate if ever there was one. The damage he did to this country is deep. He is calling the shots to this very day, and mark my words: If Biden wins, Obama’s protégé Susan Rice will be named Secretary of State; Fauxcahontas will be Secretary of the Treasury; and the utterly insufferable Adam Schiff will be tapped for Attorney General.

Obama was precisely what the founders were trying to prevent when they excluded the children of foreigners with the natural born citizen requirement.

Only someone who was born here of citizen parents is naturally an American.

The children of foreigners are themselves foreigners, even if born here and also awarded US citizenship.

IF the Dems win they have no need to put Trump supporters in jail. In fact they would dial things back a bit and watch the GOP implode. McConnell and Romney will do their dirty work for them.

Where was President Trump while this was going down?

He has the power to publicly release every prosecution document and communication in the case.

When rock solid Conservatives get legally assaulted by the Political Left - Judge Roy Moore, EPA Director Scott Pruitt, Rep. Steve King, Rep. Stockman - Trump just disappears.

I'm waiting to see if Trump walks away from the Postmaster General - during the same week that Trump openly speculated about giving Edward Snowden a pardon!

Take amnesty for instance. A Democrat controlled Senate could easily get rid of the filibuster rule and ram through amnesty with 50 votes. But why do that when they can get some GOP votes for the 60 vote cloture, pass amnesty and stoke a GOP intra party civil war? When Republicans are fighting each other they are not engaging Democrats. That’s why Romney is always trying to start a food fight with POTUS.

I am not conversant with the intricacies of Federal election law, nor the personal dispositions of the SCOTUS judges in this controversial area.

What I found interesting was the fact disclosed in the discussion of the third issue, that Stockman’s lawyers did not object to the instructions as given. The court instead gave the standard instructions, minus the “political activity” component Stockman now says should have been given sua sponte.

I wonder why Stockman’s lawyers did not make a request to charge on the issue given it’s seeming importance. Did Stockman’s appellate lawyers argue that his trial lawyers were ineffective by failing to request a specific instruction?

One reason I find this significant is that a part of the trial strategy I ASSUME would have been that Stockman was just exercising his protected rights. A request to charge to that effect should have then been an object of that strategy. Why was it not requested? I don’t know, but it put Stockman at a distinct disadvantage on appeal, changing the standard of appellate review to a less favorable one.

The first issue sounds very promising based just on the brief alone. The Fifth Circuit may very well have been over-inclusive in its interpretation of McConnell, reading too much into that decision. Having no familiarity with that law or those cases, it made good sense to me.

The second issue struck me as flailing around. Jury findings are very, very hard to overturn just to begin with. Some of the hardest cases are the ones where the guy promises to put in a new concrete driveway and then takes your money and runs. The concrete guy is not protected by the First Amendment, but I wonder how different this case is even with the First Amendment considerations. Certainly, what Stockman did, as the brief concedes, sounds sleazy. That is just a subjective impression based on the brief, which did not otherwise strike me as conclusively persuasive on the issue.

On an issue I do know about, the brief was twice as long as it had to be. It could have been and should have been far more effective at half the length, but that requires a lot of work to do.
