He could have gathered former Rebels and refought the war through guerillas but he chose peace instead. They took his land to make Arlington Cemetery. Technically, the land was inherited by his wife from her father, George Washington Parke Custis, with the stipulation that she could never sell it, and that it then pass to her son, Custis Lee. Robert E. Lee never had any ownership of the property. In 1877, Custis Lee sued the government and won back the estate, then turned around and sold it to them.
