The 12th amendment says they vote by ballot, not recorded yays and nays. In this country, ballots have always been secret.

The majority opinion, written by Circuit Judge Carolyn Baldwin McHugh and joined by Circuit Judge Jerome Holmes, stated that “The text of the Constitution makes clear that states do not have the constitutional authority to interfere with presidential electors who exercise their constitutional right to vote for the President and Vice President candidates of their choice

The lone dissent argues that the plenary power of the state to appoint electors may not be conflated with control over the electors once voting has begun, in line with Justice Jackson’s concerns in Ray v. Blair.[11]

Baca was overruled by SCOTUS (well, RFDed with instructions to follow the new precedent. And the Baca circuit majority was full of shi’ite when it claimed that prior SCOTUS precedent clearly held that states could not interfere with presidential electors’ votes.

BTW, I agree with the SCOTUS decision that states can punish faithless electors and even replace electors wo do not vote as they had pledged to vote.

Agreed. That is one of the biggest electoral issues coming down the pipe. I find the concept itself repugnant in its conception, besides being corrosive and destructive to the Republic.

Yes and the Deconstructive New Left press was gleeful, always gleeful to do anything to take America down.

Notice how they like to push that America is Racist on the 4th of July quoting folks like AOC and Omar? Am sure it is largely intended to be just as Deconstructive as these folks are.

You can expect them to start sneering whenever Holy Matrimony or the church is brought up. Their plan to Deconstruct these is well underway.

Their goal is Marxism, Communism or Socialism if they can get it and all American Freedoms gone.

I agree with the Baca decision and Thomas’s opinion in Chiafalo. State can enforce law to replace electors.

I don’t agree on fines and criminal charges. For political behavior.

I don’t care about the rat electors but those 2 assholes in Texas should have been shot out of a cannon. I suspect the Paul one wouldn’t have done it if the vote had a mattered but that prick that voted for Kasich/Fiorina.....

What if he had been just 270 Trump. Contingent election between Trump, Clinton and Colon Bowel....

I don’t think it will be an issue this time, for either side.

But those 2 jerks need to punished for disrupting the mathematical purity of 306. Though it was amusing that Pence got 305 and Trump 304, meaning Trump is VP under old rules.

1800 style Contingent election between Trump and PENCE would have been fun. Would rats have really voted for Pence?
