Gregg Jarrett: Flynn judge wrong to allow anti-Trump former Watergate prosecutors to interfere in case [Good read]

It’s a sure sign of desperation whenever lawyers try to raise President Richard Milhous Nixon from the dead.

And so it is that a group of former Watergate special prosecutors this week resurrected the Ghost of Watergate Past in a last-ditch effort to keep alive the federal court case against former National Security Adviser Michael Flynn.

The gang, adopting the sobriquet “Watergate Prosecutors,” asked permission from U.S. District Judge Emmet Sullivan to allow them to intervene in the Flynn case so they can – to put it bluntly – tell his honor how to think and what to do.

The judge issued an order Tuesday indicating he will soon accept “amicus curiae” (“friend of the court”) submissions in the case.

But in trial court proceedings involving crimes, only prosecutors and defense attorneys are permitted to be heard. Judges are supposed to render decisions based on evidence and arguments presented by the parties involved, not outside interests.

The prosecution of Flynn, a retired Army lieutenant general, has been on life-support since the Justice Department belatedly moved last week to dismiss charges against him. He was accused of making false statements to the FBI during an interview that was nothing more than a devious perjury trap designed to “get Flynn to lie.” The FBI was creating a crime, not investigating one.

A review ordered by Attorney General William Barr discovered that former FBI Director James Comey’s agents and Robert Mueller’s special counsel hit squad concealed vital exculpatory evidence from Flynn and his attorneys. The hidden documents showed that the retired lieutenant general did not lie to FBI agents, despite his coerced guilty plea under threat.

The former Watergate prosecutors now want to meddle in the Flynn proceedings like uninvited house guests...

Looks like U.S. District Judge Emmet Sullivan is an activist judge running a kangaroo court.

Deep throat was sentenced to prison for his own abuse of power at the FBI where he spied on the weather underground with black bag operations not that far removed from what Obama did to the Trump campaign.

Judge Sullivan is just trying to save face.

He’s not smart enough to write a compelling brief on his own, so he’s hoping his political allies will write one for him.

It’s also why Bill Ayers by his own admission is guilty as sin yet free as a bird for bombing the Pentagon.

Flynn’s case is a corrupt investigation. Fruitless too. Convicting a ham sandwich.

Bill Ayers was a traitor in support of the North Vietnamese military who committed a terrorist act. Oh but there were agents who bugged his residence. And “free speech” and “freedom of association” I guess.

Prediction: This Judge wants to set new precedent and will allow the filings. That means this is going to the USSC.

That's tantamount to the judge ordering the DoJ to pursue the charges. Don't think he can do that. He may try though and that'll force this up to the USSC, as will allowing third-parties to file briefs in the case.

Indeed. Sullivan is doing everything he can to deny Flynn his freedom.
He should be impeached.

I have no idea unless Sullivan goes ahead and sentences LtGen Flynn, then President Trump will pardon him immediately in my view.

So a week ago the SCOTUS excoriated the 9th Circuit for using similar groups of outside agitators to decide a case.

Since when does the self elected Gang of Tormentors get to insert themselves into a case?

Does the Defendant get a say? Or is he chopped liver?

Flynn’s liberty isn’t restrained in any way, I don’t think.

I suspect he doesn’t feel free to speak his mind for as long as he’s subject to King Sullivan’s venom, but he’s free to move about.

I somewhat welcome this sort of action by the courts, because it shines a light on how rotten the judiciary is, as an institution.

Notice no judges are speaking out against this sort of crap.
