Comrade DeWine Vows to Veto Bill Curtailing Health Director's 'Ultimate Authority' and Limiting Stay-at-Home Orders

The Ohio House on Wednesday passed a bill stripping the state health director of some emergency powers and limiting stay-at-home orders to 14 days, requiring the approval of the legislature for an extension. Gov. Mike DeWine, a Republican who’s been basking in the praise of Democrats and the MSM for his heavy-handed approach to containing the coronavirus pandemic, has vowed to veto the bill.

SB 1, which originated in the state Senate, was designed as a measure to reduce regulations in the state. When the House got its hand on it, they added language curtailing the powers of the state health department and altering the language of an archaic 1908 rule passed to deal with a tuberculosis epidemic, which has remained largely unchanged since then. Ohio Revised Code 3701.13 currently states:

The department of health shall have supervision of all matters relating to the preservation of the life and health of the people and have ultimate authority in matters of quarantine and isolation, which it may declare and enforce, when neither exists, and modify, relax, or abolish, when either has been established. [emphasis added]

DeWine, through health director Amy Acton, has used this statutory power to issue sweeping orders, shuttering businesses and ordering Ohioans to stay at home during the COVID-19 crisis. DeWine has defended Acton and warned Ohioans that criticism of her is out of line. “I’m the elected official,” he said. “I’m the one who ran for office. I’m the one who makes the policy decisions. The members of my cabinet, Dr. Acton included, work exceedingly, exceedingly hard, but I set the policy.”

But whether he likes it or not, DeWine has no authority to issue emergency health orders — Acton and Acton alone does, which is why all his edicts are funneled through her office.

This actually looks like a Veto Override is possible.. the leadership in Ohio Senate and House are in agreement and are incredibly vocal as they know that blowing up the working base of their small business supporters is a bad idea.

Read the article before going nuts. Ohio pubbies are on the job. This just germinated a week ago when John Becker proposed it, and now the Ohio House and Senate are both screaming full bore. The Ohio legislature has a 3/5ths veto over-ride and the Republicans have this supermajority right now.

The did it to Kasich in 2018....

Dewine is not a rock solid conservative. He irritated the daylights out of me when he was in the Senate. He is wrong on this issue. Acton must not have this much power.
Ohio is playing games with the Corona numbers, saying “This is the number of confirmed cases, but we think it’s really this much higher.”

The highest law of Ohio, the Ohio Constitution states … “emergency laws necessary for the immediate preservation of the public peace, health or safety, shall go into immediate effect. Such emergency laws upon a yea and nay vote must receive the vote of two-thirds of all the members elected to each branch of the general assembly…” Article 2 Section 01d – Emergency Laws

Lyin’ DeWine is 74 - hopefully he does not run again. He has been a spineless coward his entire career - he got crushed against horrible Sherrod Brown. I was shocked when DeWine came back and won as AG. His time has passed.

Yea but, This 1909 thing has been stretched to make Acton an absolute dictator for as long as she is willing to say she needs to be. Witness her suspending our right to vote without a second though or any possibility of review.

Certainly, this is unconstitutional, but you have to get this all of the way through the courts and people are starving. People are stealing stuff to live. And, they know that the law will not pursue them.

And, its going to get worse unless someone reigns this in. The facts and the science have turned on the whole shelter in place concept. It didn’t and doesn’t work. 60% of the admits to New York Hospitals are coming from shelter in place citizens. And, people are gaining weight, the very one thing that makes them more likely to get sick. Meanwhile, we find out the one place where this stuff can’t live is outdoors in the sunlight. Imagine that.

The legislature could have filed suit and won if they’d have wanted to. My opinion, but the constitution would have given a solid chance.

These Health directors or cabinet Secretary of Health which is what they call it in PA have been shown to be criminally incompetent. Even more outrageous than keeping business closed was what they did to those in nursing homes. What should have been the safest places to the most vulnerable elderly were turned into a killing machines by bureaucrats and governors. Did they send covid19 infectious patients into nursing homes to recover from hospitals purposely to kill nursing home residents? The power to murder through incompetence can never be omnipotent.
