Supreme Court Allows Enforcement of Trump Remain-in-Mexico Asylum Policy
Supreme Court ^ | March 11, 2020 | Supreme Court of the United States

Posted on 03/11/2020 11:27:17 AM PDT by JOHN ADAMS

The Supreme Court issued an Order this morning, at the URL above, staying enforcement of a trial court order that had barred the Trump Administration from enforcing its policy requiring those applying for asylum having come from Mexico to remain in Mexico until the application is ruled on. The policy is being challenged in court, and the Trump administration has asked the Supreme Court to review the trial court order barring enforcement. The Supreme Court says today that Trump can continue to enforce the policy while the legal challenge continues.

One is tempted to read the tea leaves and see this as an indication that the Court will uphold the policy. But one can never be certain. It is true, though, that a different assessment of who was being wronged would likely have resulted in an order to make Trump not enforce the policy while the case continues.

Oooh, this should bring the noise from the socialists.

Can’t wait to hear how letting the invaders into America will protect us from exposure to diseases.

Can you elucidate on this?

This is a big deal. No Catch and Release and Remain in Mexico policies radically reduce the number of “asylum seekers” who game their way into the US.

Not tired of winning.

Ginsberg is probably at home getting her affairs in order. She is certainly high risk for Covid-19 with her comorbidity.

There should be a provision for lower court judges that if they are overturned so many times, they're out! That way those playing politics and legislating from the bench would be removed.

I think that due to the coronavirus hysteria along with economic realities that you will see to southern border wall build from sea to shining sea, the imposition of huge restrictions on immigration, mandatory testing for all arrivals into the US, and a desire to relocate a lot of manufacturing back to the US.

Article III, Section II of the Constitution states: “ In all the other Cases before mentioned, the supreme Court shall have appellateJurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.”

Congress has the power to determine the jurisdiction of courts under the Supreme Court. The Constitution provides for the specific jurisdiction of the Supreme Court.

If the GOP were serious about the rule of law, Congress under House Speaker Ryan and Majority Leader McConnell could have passed legislation specifically eliminating the ability of individual federal judges and courts to issue decrees from the bench wiping out laws and preventing the president from executing the laws of the country.

Paul Ryan and Mitch McConnell completely wasted 2 years when they had a GOP president (Trump) in office who would have signed any legislation put in front of him. Much good could for the people and the nation could have been accomplished. Unfortunately Ryan was apparently a Trojan horse, purposefully obstructing the president and preventing conservative legislation from being written and passed. Sadly, McConnell facilitated the inaction with the help of Romney, Collins, Murkowski, Sasse and a few other weak kneed GOP Senators.

Judicial reform is badly needed. The courts have become politicized along with the Justice Department. Even if the GOP wins the House and Senate in the fall, and Trump is reelected, I don’t see Speaker McCarthy and Majority leader McConnell up to the challenge of taking on the leftist black robed tyrants in the federal judiciary. Too many K Street dinners to attend. Too much legislation to pass for the donors.
