The State has access to an almost unlimited source of funds to prosecute an individual who is paying out of his own pocket. To level the playing field it is necessary to make the State pay the legal expenses of the defendant. How else can there be a disincentive to the State to bring these actions?

Thus there can be no loss or termination of rights unless actual damage is proven. Many imposter laws were repealed as a result of this case.
