The Supreme Court will consider Obamacare's constitutionality — and the outcome could bring 'total chaos'

The Supreme Court has agreed to hear an appeal case on the Affordable Care Act (ACA), commonly known as Obamacare, that could potentially invalidate the entire law.

On Dec. 15, 2018, a Texas judge ruled that Obamacare’s individual mandate was unconstitutional. Judge Reed O’Connor agreed with the plaintiffs who argued that the lack of a penalty invalidated the “individual mandate” provision of the law, and if that part of the law was now invalid, then the whole law was.

Democratic states and the House of Representatives appealed the decision, and the case made it all the way up to the Supreme Court in a case titled California v. Texas. If the conservative-majority justices find the individual mandate unconstitutional in the June 2021 ruling, that could mean all of the ACA is unconstitutional.

“There could be essentially total chaos,” Cynthia Cox, director for the Program on the Affordable Care Act at the Kaiser Family Foundation, told Yahoo Finance. “There’s no replacement plan that is ready to go and so essentially what would happen next is possibly over a short period of time, or possibly immediately, we would start seeing the ACA being unwound. And the immediate effect would be that literally tens of millions of people could lose coverage and also even more people could have other changes to their coverage.”

“What [would] happen is we’re going to go back to a marketplace that we had before the ACA,” Gerald Kominski, a professor in health policy and management at UCLA Fielding School of Public Health, told Yahoo Finance. “Roll back the clock 11 years. First of all, there are no longer subsidies for people to buy health insurance in exchanges. Exchanges go away.”

One can only hope.

The government can't even run the DMV or PO efficiently.

I DON'T WANT them in charge of my healthcare.

If they had correctly declared Obamacare unconstitutional the first time, it wouldn’t have destroyed the healthcare business and driven all the doctors and hospitals out of business, resulting in the present healhcare shortage and skyrocketing premiums.

Unfortunately the sitting President would get the blame!
The average voter is not going to put two & two together and deduce who is to blame. They’ll just know today I don’t have what I had yesterday and someone’s to blame - president. People want a president but sometimes they want him to function like a king.

Actually there is what is known as Catastrophic Care Insurance that is widely available from private firms at a lower cost with no humongous deductible

The program is called buy from the market rather than be hobbled by the government

Subsidies to buy health insurance. What could possibly go wrong there?

If you think throwing student loan money at colleges caused 400% tuition increases like welfare for colleges, just wait until the same happens in healthcare.

The next logical step will be federally subsidized and guaranteed healthcare loans. That way when you have finally paid off your student loans at the age of 50, you are given large loans to tackle your cancer treatments.

We don’t have a free market in medicine and haven’t for decades.

Government already controls an enormous amount of pricing through Medicare and Medicaid patients. That’s not even touching the licensing and other barriers to entry that every state has in the field of medicine and insirance.

Ending ACA isn’t going to be a return to free markets.

The question is how prepared will the GOP be for the fallout.

Of course he will. The outcome is 100% predictable - 5 to 4 with Roberts voting with the Leftists.

And note: To fail to do so would paint Roberts as a complete idiot in the history books. What Chief Justice would want that? Surely that is a more important issue than the quality and cost of healthcare in this country. People will get used to the higher cost and lower quality of their healthcare but besmirching John Roberts’ reputation would be impossible to overcome.

Priorities are priorities after all.

Roberts ruling was one of the biggest shocks to me in our free enterprise system. The "tax" (written as a fine) he claimed aside, how could the Fedgov force American citizens to buy a product under penalty of law??

What ! People shopping for their own health care ? Preposterous !

Except it would immediately lower prices, drastically. Doctors competing for business, able to charge less with a fraction of the paperwork , getting paid sooner, no middlemen. Drug companies similarly competing for sales with lower prices.

As I understand it, the mandate had to be deemed a tax for it to pass. Not sure how this affects Robert’s thinking.
