It has never been used in a prosecution however many times threatened. I don’t expect it to be effective in John Kerry’s case (of whom I heard served in Vietnam).

They could of cut ads in black radio stations telling them that Obama gave $150 billion to Iran....and none to help the black community. Such an ad would have buried the Democrats.
