Top FISA Court Judge Condemns FBI for Providing ‘False Information’ to Court, Demands Prompt Government Response

FISA Court questions whether ‘information contained in other FBI applications is reliable’.

Less than a week after Department of Justice Inspector General (IG) Michael Horowitz released his investigation detailing FBI misconduct in obtaining a FISA spy warrant on a Trump 2016 presidential campaign aide, the presiding judge of the FISA Court, Rosemary Collyer, issued a Four-Page Response Order on Dec. 17, 2019.

This unprecedented order by the FISA court condemned—and verified—ongoing wrongdoing by the FBI in the entire approach to the FISA process. Judge Collyer’s order also highlighted just how serious these breaches of conduct actually were, and the potential fallout that could result from the FBI’s actions.

Collyer noted that the FBI’s actions were so egregious that their behavior “calls into question whether information contained in other FBI applications is reliable.”

In the order, Collyer, who signed the original FISA application on Carter Page, said that the FBI “provided false information” and “withheld material information” from the Justice Department’s National Security Division (NSD) and in doing so “equally mislead” the Foreign Intelligence Surveillance Court

The December 2019 report by IG Horowitz—which provides a condemnation of activities undertaken by the FBI during its pursuit of the initial Page FISA and the three subsequent renewals— noted the role of FBI agents in their failure to disclose material information to the Office of Intelligence and to the FISA Court:

Collyer addressed the material email alterations made by Kevin Clinesmith, a senior attorney in the FBI’s Office of General Counsel, which were used in a crucial part of the Page FISA renewals. Clinesmith’s email alteration deliberately removed the fact that Page had “a prior relationship” with another governmental agency, and Clinesmith has reportedly been referred for criminal prosecution by Horowitz for his actions.

The judge has full authority to issue a bench warrant to remedy this.

First, I agree with others, that the judge knew two years ago. In fact, Admiral Rogers reported this and was supposedly working with the chief FISA judge two years ago to “get to the bottom” of this. And yet, only now is the judge demanding answers. This is CYA. The judges were complicit.

Since Justice Roberts is over the FISC, he is also complicit.

Second, solving the problem doesn’t mean changing the rules, or adding more rules. It was already against the rules to lie to the court. The answer to fraud is jail time.

So the fisa court judges didn’t notice any thing wrong over tens of thousands of rubber-stamped (by them) fisa applications...and NOW they are whining? I’d say they are incompetent boobs. They only rejected three hundreths of a percent (.0003) of the “applications”. Pretty discriminating, no??? Can you say “rubber stamp” or “kangaroo”?

What she DIDN’T DO is find them in contempt, refer a perjury charge, and quash the warrant.

Warned in 2015 and 2017 BY Nunes and Adm. Rogers, this comes a little late to the party.

I understand she is resigning. Great, but she let the damage to the country go forward by her (a)partisanship or (b) incompetence.

Exactly- They aren’t serious about this at all- if they were- people would be losing their jobs, and investigated, and the whole impeachment lie would be thrown out because of the absolute bias and bold faced lies used to obtain the warrants- I don’t know what the term would be for reversing the findings of a hearing due to false information used to come to the conclusions- in a trial the judge would issue a mistrial- but whatever it is= it should be issued immediately, and everyone involved in this scam and lie should be brought up on charges of abuse of power and lying to the court for nefarious reasons-
