A curiously interesting development in the DOJ case against Michael Flynn. Judge Emmet Sullivan is weighing the merits of the Flynn defense Motion to Compel (MTC), which requests a significant amount of information on DOJ/FBI conduct in the lead-up to Flynn’s prosecution. A decision and court briefing was anticipated soon.
However, today the DOJ files a joint motion with the defense asking Judge Sullivan to delay any decision on the MTC until after the DOJ inspector general report is published on December 9th. The implication is that some of the “Brady” material at issue may be outlined in the IG report.

I’m scratching my head on this one. Everything has been super adversarial to this point. The defense has asked the judge to nuke the prosecution and now all a sudden they file a joint motion?
Huh?
Why go to all this trouble when the NYTimes/ Washington Post said the IG report is a big nothing?

1h If the Court grants the order, the sentencing date will evaporate and we will have time to digest the IGreport and Judge Sullivan's next order.
It’s not a big nothing. But it won’t be what it SHOULD be.
It should call out the political bias and illegal activities of the top brass in the DOJ and FBI. But instead it will call the top brass inept leaders who if they knew what they were doing would have prevented this crap from ever happening. And what crap did happen? Well some low level lawyer lied on documents setting off a chain of events that never should have occurred.
So they found their fall guy. The top brass who are all gone now anyway will be called bad bureaucrats and one guy will go to jail. But DOJ will say he cooperated with the investigation so he should get a light sentence. Never mind the billions that were wasted and the 4 years lost on the Trump administration because of his lies.
Trump will get to say he was right and the FBI targetted his campaign and illegally spied on him. But no one of importance will go to jail.
And the reason why...if Barr put Comey in prison all his cases would then be up for review and many criminals he a part of putting in prison would likely go free. So Barr doesn’t want to be known as the AG that let rapists and murders go free—that’s how the media would spin it. But he also doesn’t want to let the democrats get completely away with this. So he is trying to thread a needle...and he will fail.
Luke warm will be spit out by the right wing. Trump supporters get prison for process crimes from an illegal witch hunt while real criminals in the coup go free—not even tried in a court of law. No family ruin by needing to spend money on a defense. No raids at 2am with news crews filming. Nope...the deep state won.
Perhaps it has finally dawned on the DOJ from watching Trump that he is certain to make everything public at some point.
The Swamp operated in secrecy for so many decades that it is just now dawning on them what is coming.
Read between the lines.
While the Motion says it is joint, the defense didn’t sign off on the motion. Interesting to say the least. There is a pending motion to compel. How devastating would it be to respond and fail to produce documents included in the IG report. Slam dunk then for the defense. I rather the prosecutor has something up his sleeve.
No, deliver it now and les see if there are discrepancies, AKA lies.
Maybe the DOJ is thinking about withdrawing the entire case if certain things are released in the IG report. That might save their lawyers from being hrld in contempt.
They don’t want to do anything else that will get them in more hot water.
They want to see if they are clear, so they know what they can or cannot get away with.
Judge should make them finish up NOW!
Because when it comes out the FBI and others framed Flynn they do not want to take the fall and get disbarred, prosecuted, and sued for Mueller and Comey everyone else who started this.
The motion appears that it isn’t signed by Flynn lawyers however it looks like they are OK with it according to this article.
“The new move by prosecutors is significant, said Flynn’s defense attorney Sidney Powell. She told SaraACarter.com that “it is the only thing for the government to do–short of producing the information we have requested or dismissing the case on it’s own motion.””
“This gives us time to digest the pending IG Report and the thousand plus pages of facts it contains,” said Powell. “Clearly, we will have additional motions to file upon receipt of Judge Sullivan’s order and additional evidence.”

I think someone at the DOJ is feeding Sydney information behind the scenes.
It sounds like a “it’s not my fault” is coming from the lawyers.
