What part of the Constitution is Kentucky violating with their stupid law?
And wouldn’t the Feds be violating the 10th amendment (states rights) by imposing a law on Kentucky and all the other states?
My first heart attack, in 2011, I drove myself to the hospital (about eight minutes). Had I awaited an ambulance it would have been more than a half hour. Mrs. JimRed was visiting a sister in Ohio at the time, so no driver was on hand.
I cant believe a freeper would come up with that?
Not bigger government, but insisting that existing government DO ITS JOB!
People have a right to engage in commerce. Congress can only regulate it, not interfere in such a way that it prevents commerce, which this state is doing for some.
So I’m not talking about the imposition of a law. I’m talking about enforcing the constitution.
Did you understand my 2A example?
Here’s something more specific:
1) Constitution says right to bear arms not to be infringed.
2) A State passes a law that says you cannot carry a gun in your car except in a locked case.
3) Feds sue to repeal that law since it infringes the right to bear arms.
So it’s not about passing new laws, but getting rid of bad ones.
“My cousins husband had a heart attack and she drove him to the hospital. Both are alive and kicking.”
When I had a heart attack I spent my time in the ambulance getting CPR for 11 minutes and two shocks from an AED. A private ride probably wouldn’t have been able to provide that service and I would be dead as a door nail.
My childhood friend’s dad drove himself to the hospital with a heart attack. Glad you made it!
My Girlfriend’s nephew taught his son to ride at age 5. The kid is 13 now and smokes his dad and uncles when they race around the cornfield.
You didn’t answer my question...
“What part of the Constitution is Kentucky violating with their stupid law?”
As for your 2nd amendment example, it is also wrong.
“3) Feds sue to repeal that law since it infringes the right to bear arms.”
The fed wouldn’t sue. Some private party that feels “wronged” would sue, claiming that the law is unconstitutional. It would then work it’s way through the various courts. A lower court could find it unconstitutional, and if the parties decide to stop there then that is that. If not it may end up in the supreme ct.
The commerce clause.
If you think the Feds have no authority to enforce the constitution and cant sue a state then we will never agree.
“The commerce clause.”
The commerce clause is to regulate commerce between states nor commercial activities within a state, which is what that law does.
“If you think the Feds have no authority to enforce the constitution and cant sue a state then we will never agree.”
You can continue to be wrong, then.
Its an enumerated power meaning they can only regulate it. They can make certain commerce illegal, like prostitution, in general but not keep it legal but regulate to the point of excluding others, whichd be a violation of equal protection.
If you think the Feds cant enforce the constitution you are an idiot. The Feds also have statutes, they enforce those too. Or do you think the constitution is subordinate to statute, making you twice the idiot?
I dont think theres anything you can do to cure this stupidity but you can cure your ignorance of the US ability to sue states by searching on United States vs California or some other state and see how this does indeed happen.
I suspect you are either an illegal immigrant or the product of the modern school system to be so ignorant of this. Have a nice day retard.
Gee, I must have hit a sensitive nerve of your pea brain.
Sorry about that.
But in the future, please try to stay away from discussions that requires thinking - you’re not good at it, and it’s just too traumatic for you. OK?
So says the retard that thinks the Feds cant enforce the constitution.
Now, I don’t want you playing with knives or matches -I don’t want you getting hurt! OK? Promise me?
