Judge Strikes Down 3 Laws Limiting Assault Weapons, Ammunition In Pittsburgh

PITTSBURGH (KDKA) – An Allegheny County judge struck down three gun control laws that limit assault weapons and ammunition in Pittsburgh.

The laws were passed after the shooting at the Tree of Life Synagogue.

In 2018, the City of Pittsburgh made three proposals to regulate firearms, ammunition, and firearms

The court struck down the ordinances, saying the city didn’t have the authority to implement them.

Director of Communications for the Office of Mayor Peduto says in a statement:

“The City and its outside legal counsel have always expected this would be a long legal fight and will continue to fight for the right to take common-sense steps to prevent future gun violence. We will appeal.”

Guess I mixed it up with some of the older stuff. I just googled PA law enforcement gun storage and got this:

Point is they’re fretting about where to store all these guns, not about the citizenry resisting.

Some are eventually returned to their owners, others not.

In any case, a PFA order will make you miss your guns in central PA and this region is armed to the teeth, so the police are going to need more closets.

“Assault Weapon” is a BS term coined by the liberal media thirty years ago. Yes, I know “liberal media” is a redundant term.

Semi-automatic rifles, intended for the civilian market, is what I call them.

The gun-grabbers can go pound sand.

Sadly, the judge didn't rule because of the state constitution, but because Pennsylvania has a preemption law that prevents localities enacting laws stricter than state law.

Will be appealed, but should be a slam-dunk as it clearly violates the Pennsylvania Constitution.

Violates 18 Pa.C.S. § 6120

§ 6120. Limitation on the regulation of firearms and ammunition.

(a) General rule.--No county, municipality or township may in any manner regulate the lawful ownership, possession, transfer or transportation of firearms, ammunition or ammunition components when carried or transported for purposes not prohibited by the laws of this Commonwealth.

The Connecticut Constitution says the same thing, but that hasn’t stopped the unconstitutional laws in CT.

I believe there have been other similar cases in PA and the municipalities had to pay the legal fees if the challengers. Thieve “laws” are clearly preempted by the state law.

They are NOT regulating “Assault weapons”, they are attacking our RKBA using irrational fear mongering.
Yes, there have been outrageous tragedies, but not to the point of significantly altering this simple truth.
firearmns are still overwhelmingly used to PREVENT orders of magnitude more crimes than they are used to commit.

I am only one guy that knows a handful of police, how did you translate that into my endorsement of the entire police department?

I don't want to go full politician on you, but don't hang the entire PPD around my neck.

The PA Supreme Court is stacked with Soros stooges. That was always the end game here. It doesn’t matter that the Constitution is clear and the existing PA case law is against the gun grabbers. They want the Soros stooges to creatively reinterpret the Constitution from the bench like they did with redistricting.

It took 20 posts for someone to nail it. Just like redistricting, the PA Supreme Court will take this and throw out pre-emption, allowing every little borough and community to write their own firearm laws.

This was the goal in tacking our state supreme court with socialists. North Carolina is in the same situation.

The socialists cannot win at he ballot box, so they will use the court system to implement their agenda.

Sadly true. Two PA Supreme Court justices are up for election in November and it would be nice if we could get them replaced, but I am not overly optimistic.

I believe the last GOP justices on the PA Supreme Court were the corrupt Orie harpies who poisoned the well for awhile.

I still shake my head about how the PA GOP rolled over for the redistricting ruling two years ago which helped give Pelosi control of the House.
