Switzerland’s supreme court rules parents have no right to homeschool their kids

GENEVA, Switzerland, September 18, 2019 (LifeSiteNews) -- Switzerland’s top court ruled that parents do not have a right to homeschool their children.

On Monday, the Swiss Federal Court ruled against a mother from the city of Basel who in 2017 had applied for permission to school her 8-year-old son at home. School authorities rejected the application and a cantonal court threw out the mother’s appeal.

When she brought her case to the Federal Court, the mother held that the appeal court’s decision was tantamount to a ban on private instruction at home, thus violating a constitutional right to privacy and family life.

The high court, however, rejected the mother’s argument, ruling that the constitutional right to a private life does not also apply to homeschooling. The court noted that no international treaty grants a right to homeschooling.

In addition, the Federal Court ruled that Switzerland’s cantons may decide whether to authorize homeschooling or to ban it outright. In Basel, homeschooling is allowed if applicants can show that the child’s attendance at school is impossible. The Federal Court had ruled earlier that national law does not explicitly grant a right to private instruction at home. Nevertheless, it ruled that cantons may decide how they comply with federal requirements for basic education.

Cantons are semi-sovereign administrative divisions that make up the Swiss federation.

By saying homeschooling creates inequalities she is admitting homeschoolers get a better education; and then she throws in the debunked socializing nonsense as a hail mary because the State must keep control of the children and parents must think only the State can succeed. Sigh.

The Judicial Supremacy virus seems to be worldwide. There needs to be an inoculation that would make judges really think about the consequences of their decisions and put them on the line personally for such decisions.

I read the article and the situation is technically not the end of the world. I went to the original ruling but I can't read French or German or Italian(!). However the article says basically that the Court ruling applies only at the federal level only and that:

Switzerland’s cantons may decide whether to authorize homeschooling or to ban it outright... Currently, according to the Swiss Broadcasting Company, there are more than 1,000 children being homeschooled in Switzerland. Regulations vary widely throughout the cantons. While some require official authorization and teaching certificates for parents, others only call for notification.

In some ways this is no different from the States, where HSing laws vary greatly - in NJ you have almost no regulation (surprisingly) while MA, PA, and NY have very onerous regulations including the requirement that a local bureaucrat approve your HS Curriculum. We haven't yet had a SCOTUS ruling on HSing and, frankly, I'd prefer to keep this a State's rights issue.

If I'm charitable, this court ruling simply says the federal constitution does not guarantee a parent's right to HS but locally you can, Canton permitting. What IS troublesome is that Switzerland's federal Supreme Court relied upon international law in part of their ruling.

That is one of the worst arguments for public schooling ever. Throwing kids into groups in which they have no chance of ever knowing every member of the group creates stress and causes withdrawal; our instincts never developed to be in community groups of over about 200. The extroverted kids will form social networks, while the introverts struggle and may never form connections. Plus, the extroverts will often pick victims (isolated introverts, of course) and harass them mercilessly; the forms of harassment have become much more sophisticated because of technology. Liberal society only notices bullying when the victim is from a protected class, e.g. LGBTQMRXIS, but utterly ignores other victims. And being a victim of bullying creates a huge risk factor for suicide, along with a host of other psychological problems.

No, you do not send kids to school for socialization. You send them there to learn social pathologies. If you want them to learn social skills, you send them to play in small groups, for instance, at a local neighborhood park.
