I thought illegal border crossings were a civil law issue in the first place.

Its both, 8 USC 1325 refers to illegal entry, first offence is a misdemeanor and a second offence is a felony.

8 USC 1326 reentry after a formal deportation is a felony with incarceration enhancements for any criminal convections committed in the US.
