No Grand Jury indictment has been returned against McCabe?

Just in: Andrew McCabe’s legal team says in a new letter to Jesse Liu that based on their conversations with the US Attorney’s office in DC yesterday, “it is clear that no indictment has been returned” against McCabe by the grand jury.

Now, they’re asking whether the grand jury indeed declined to bring charges, and argue that if it did, “the justice manual compels you not to resubmit the case to the same or a different grand jury.”

If it was a grand jury empaneled in D.C., I have no doubt that it failed to return charges.
All cases involving FedGov Swampers must be moved FAR, FAR AWAY from Washington, DC.
It’s a company town where nearly everyone is conflicted.

a grand jury summoned back after a months-long hiatus to consider the case — the day came and went with no public charges being filed. Grand jurors were sent home..
... To bring an indictment, prosecutors would have to persuade 12 of the 23 grand jurors to sign onto the decision. If grand jurors turn them down, it is possible for prosecutors to call in a new group, though they would then have to restart the process.

No. First go around the US Attorney didn't bother. All decline to prosecute decisions are made by a prosecutor.
