After a North Carolina sheriff released an illegal immigrant on bond in a child rape case, former acting ICE Director Tom Homan said the law enforcement officer should have called the federal government and had the suspect detained.
The suspect was finally apprehended by federal authorities, two months after Mecklenburg County Sheriff Garry McFadden ignored an ICE detainer order and released him from custody.
"Mecklenburg County wants to be a sanctuary county. This sheriff has made a choice to stop being a cop and be a politician," Homan said on "Fox & Friends Weekend."
Homan said this is a common practice among local law enforcement and began listing cases where suspects were released on bond, despite being accused of heinous crimes while in the country illegally.
"I wrote a few cases down," he said. "Numerous sex offenses, people arrested for assault and larceny -- assault with a deadly weapon, rape with indecent liberties with a child, numerous drug offenses, felony possession of a gun, assault by strangulation... These are the type of people he’s releasing, rather than calling ICE."

He’s one of Obama’s people. Still, he might be a good test case for federal charges. Maybe the Portland sheriff who released the Mexican dog humper, too.

There are many around the country who deserve to be arrested. I truly don’t understand why they’re allowed to get away with it.

Please, please, please, they are not “immigrants.” An illegal has no rights and is a criminal. They are “aliens,” as in “enemy aliens.”
Mecklenburg is Charlotte...it is pretty much liberal now...not as bad as Austin, TX, but the trend needs reversing.

This sheriff should be billed for the cost to hunt him down after his release.
Yet another shining example of what happens when Southern Governors spend their time luring businesses to the South, promising all sorts of jobs for their constituents. But, instead the companies move from up North and bring all their liberal, hipster, Democratic voters with them. And, in turn, ruin a perfectly good place. That entire state is dictated by the voters in the Charlotte-Mecklenburg area, Raleigh-Durham and the Research triangle. Toss in some Democratic retiree’s on the coast and viola, North Carolina is not the Conservative state it once was and hasn’t been for some time.

Nope... an elected Sheriff is the most powerful law enforcement officer in that county. And if they’re from the largest county(population wise), which I’m thinking the Charlotte-Mecklenburg county may be, they’re considered the High Sheriff of the State. Meaning, they have to do some really crazy sh*t before they can be touched.
I kind of wish Homan would be in charge again...

Wrong. Supremacy clause. The Feds for example the FBI trump the state including sheriffs with respect to federal laws.
With respect to Federal Laws. And those laws are very defined and narrow in scope, unless of course, the feds scream Domestic Terrorism, which encompasses all things. Anything else and the Sheriff rules the roost. The Feds can’t enforce State law and if the SO isn’t part of the 287 Program, they don’t have to do anything.
So, Not wrong. The Sheriff of Mecklenburg County can tell the Feds to piss up a rope. Only time he can’t is when they Feds are investigating a federal crime within his jurisdiction. At that time the Sheriff, and deputies, can all get in their shiny Sheriff’s Office cars and drive away,not offer any assistance, nor do they have to accept any prisoners.

The US Forest Service threatened to ARREST Congressman Steve Pearce and Otero County Commissioners! Otero County Sheriff Benny House reportedly advised the feds that if they made any arrests, he would then arrest the feds on kidnapping charges.
On September 17th, keeping his Oath of Office to the Constitution and the People, Sheriff Benny House and his SWAT Team protected the tree cutters. The feds backed down! The feds were absent from the Tree Party Rebellion. This is because within the county, the sheriff is the highest law enforcement authority in the land.
