California gun rights group look to overturn state ban on assault weapons

A gun rights group in San Diego sued Thursday to block California from enforcing an assault weapons ban, citing a federal court ruling earlier this year that struck down a state prohibition against high-capacity magazines...The lawsuit...likened the term assault weapon to "a politically concocted pejorative term" for weapons lawfully used "in virtually every state,"...further asked the court to declare California's definition of an assault weapon unconstitutional and issue an order permanently barring enforcement of laws that prohibit them based on magazine capacity.

If law enforcement is "allowed" to have an AR-15 (for example), then citizens must be allowed to own an AR-15.

The 2nd Amendment is a hedge against a tyrannical government.

"Law enforcement" includes local police, local sheriff, state troopers, federal marshals, fbi, etc.

Has nothing to do with the military, who has nuclear weapons and fast attack subs. Your local law enforcement doesn't have either of those.

Whatever law enforcement has, the citizens must be able to own.

I don’t get it.

I see the word “assault” used a lot throughout the years when the perpetrator was just using a handgun.

Or a knife.

Or a bat. Or their fists.

Once it was a stiletto heel.

I hope they don’t pass a ban on “assault stiletto heels”.

A lot of trannies will be offended :)

Ever ask a lib to define an “assault weapon”? They don’t know. They believe that the letters, AR is an acronym for Assault Rifle. Perhaps they should research the actual AR15 designation starting with Eugene Stoner and Armalite Rifle.

My favorite part of Kelly’s heros was when Moriarty told Kelly about being assuallted by Tiger Tanks. He was fairly exercised about the assualted part. Try too assualt me with an assualt rock and see how that works out. I been studieing the way the Israelis do it. They are very good

Talk about eerie.. If you haven't yet read Travis McGee's novel ENEMIES FOREING AND DOMESTIC"you should check it out...
When you see the reality of the swamp dwellers like James Comey, Peter Strozok and John Brennan and read Matt's book it makes the hair stand up on the back of your neck... He wrote it in 2003 and it sounds exactly like what's happening today...

Along the same line our great Governor Wolf, here in Pennsylvania has signed a executive order to "fight gun crime??!!" So far the news has been very vague about what this order contains. I looked on line and its the same.

The focus has to be shifted from guns to the psych drugs that every one of these shooters are connected to.

There is all this desperation about doing something. Well, WHY is this not being looked at?

Tell you what... Among others, The one that also really needs to be overturned in Ca is the “Importing firearms” law. It is mass confiscation and registration of every firearm entering Ca. If allowed to stand as precedent, and be accepted as Constitutional, soon many other states will be following suit because they got away with it. .

Not really. I’d be willing to bet that the CMP has put well over 1,000,000 M1 Garands into private ownership since they became available there. It was the most effective assault weapon of its day. And in the hands of a skilled user it’s still a damned effective weapon. It’s been available to the shooting public decades longer than AR pattern rifles have been.

We simply must reject the language of the Left.

Libs don't care about definitions.

It is a mistake to argue about actual definitions vs what they spew.

The basic premise, the basic concept of disarming society because of their whims should be rejected tooth and nail at every opportunity.

The "type" of weapon is irrelevant.

And, yet, here we are, essentially barred from possessing the same ‘common’ arms used in the military?

This, along w/ his “no Right is absolute”, was the man the (R)N(C) held up as a ‘great legal mind’ & Constitutionalist???

No wonder our Republic is at Banana status

You are incorrect. The citizens of this country created a government, and cannot give powers to the government that they do not possess them selves. The Second amendment was put in place specifically so that if the government that had just been created with the constitution somehow became tyrannical, despite the safeguards in that document, that the people would have in their hands the means with which to overthrow it in the same manner as the drafters and ratifiers of the Second Amendment had just overthrown the English government.

Additionally, if you look at article 1 section 8, among the powers given to the Congress is to issue Letters if Marque and Reprisal. This is congressional authorization to civilians vto attack enemy shipping and other forces during wartime when the (purposely small) standing army and navy didn’t have sufficient forces on hand to do the job. How, pray tell, does one take on enemy forces without having equivalent weaponry? Note that the Continental Congress issued many Letters, as did Congress during the War of 1812 and afterwards, so the power is not unused. Just as John Hancock has cannon-armed ships he used to fight the British Navy, so today should individuals have the ability to have similar modern weapons.
