Why you shouldn’t worry about the DOJ not prosecuting Comey on leaked memos

Lots of conservatives are understandably upset that the IG Horowitz’s criminal referral of James Comey for leaking classified memos memorializing his conversations with President Trump is not being prosecuted by the Department of Justice. It eerily reminds us of James Comey exonerating Hillary Clinton for her prima facie violations of the Espionage Act because he could perceive no criminal intent (which is unnecessary for gross negligence to apply).

We’ve been suckered before, so cynicism is warranted. Tucker Carlson opened his show last night making this point:

But there is more – much more – to the story this time. The case against Comey for leaking is weaker and less serious than his signing of the FISA warrant applications that corruptly cited the Steele Dossier, even though it was known to be unverified. IG Horowitz has a separate report coming on that, and US Attorney John Durham is reportedly working on prosecuting that.

Watch two very distinguished, high profile attorneys – Joe di Genova and Alan Dershowitz -- discuss this with Laura Ingraham. And as you do, imagine to potential consequences of taking as the first case against Comey a prosecution that could well be lost. Once a prosecution fails, the calls to drop the “political motivated persecution” would be legion. I is important that the first case taken to a jury be rock-solid and serious.

Arrest him now and schedule the trial for a couple years from now, like Epstein. Or McVeigh. Why are we being asked to assume Comey would be tried and found not guilty in a few weeks?

Why losing is winning. These are separate crimes prosecute both. Don't tell me oh there are serious laws against leaking but when it serves the progressive goals all of a sudden its a minor thing. Don't worry though will get him on the other more serious thing. Right.

Comey is the canary - he doesn't get arrested. Its all just a farce. Agitprop garbage

If I, or anyone else who ever held a security clearance leaked Confidential Classified, I would have been convicted of Espionage and had my life ruined.

Cardinal Choir Boy Comey does it, and it's suddenly "No big deal!"

Personally, there is something more sinister and hinky with leaking the FBI memos.

Comey admits to writing memos, then taking said memos home.
A month after Comey is fired, FBI agents go to Comey’s home to pick up all Government property, including the memos. FBI swears to the fact under oath.

Now, the memos turn up at Comey’s home!!!! What the heck.

1) Why are they playing hide the memos?
2) If Comey cannot be prosecuted, why the extraordinary effort to hide the memos
3) Why was Mueller hiding the memos
4) Are these the sources and methods the CIA needs to keep secret?

The whole story and time line makes no sense.
Therefore, something deeper and more criminal is behind the leaking and lies.
All this lying and hiding could also answer why this is taking so long to process

I agree but with a caveat. Wait and prosecute this AFTER you charge and indict him for perpetrating a fraud on the FISA court.

Barr is right....You don’t want to start with a weaker, less egregious case. After all the “classification” was made post Comey leaking and there are mitigating factors involved which would make this conviction a bit iffy.

Start with the big one, you can always charge on this one later.

Because anybody that thinks anybody in the protected class is going down for anything is just plain a fool. Really folks. PAY ATTENTION. In your life you have NEVER seen one of these people go down. Why do you keep thinking it’s going to happen this time.

Makes sense. We need to pick our battles carefully and go after the ones that will give us the most bang for our buck. At any rate, someone somewhere down the line is going to talk in order to get leniency . . . and hopefully the obama/Clinton cabal will be fully exposed and prosecuted to the fullest extent of the law.

Seeing as how AG Barr has reinstated the death penalty and all . . . be a shame to waste it.

IANAHPA, but it seems to me there's clearer intent in leaking memos than in a shoddy warrant application sign off.

Cynical? I bet Roger Stone and Paul Manafort are cynical about this.
