Looks like a number of obamas appointed judges are carrying on his work of dismanteling the country. Would be interesting to know who is pulling the strings.

Re: The APA cited here is basically the same law that killed the census question at SCOTUS.

The APA applies only to federal enforcement rules and regulations written by Executive Orders or by Executive agencies.

By using 8 U.S.C. §1182(f), Trump has the power to “proclaim” how asylum seeking aliens must apply. A proclamation would bypass all the APA complexities.

Trump also has the power to proclaim a citizenship question on the Census as a completely reasonable enforcement tool related to illegal immigration.

Instead - time and again - Trump hands the Democrats slam dunk APA legal issues - which can never be resolved before the 2020 election.

Bottom Line - Trump has never been serious about enforcing all of our immigration laws.

Trump’s tough guy talk on immigration is political theater.

The Attorney General may by regulation establish additional limitations and conditions, consistent with this section, under which an alien shall be ineligible for asylum under paragraph (1). For example: must go through ports of entry.

Judge violating clear language of the law.

Luckily, the courts don't agree the the US can be ruled by proclamation.

That is the astonishing thing. That anyone has the gall to say President Trump is wrong in enforcing it. It is plainly and clearly written.

It doesn’t say “Must go through official ports of entry, unless that is inconvenient, then any application is acceptable.”

The good thing is that in one of the recent decisions in which Clarence Thomas weighed in, he said this practice of a federal judge’s decision canceling the actions of the executive branch has to stop.

I heard Dan Bongino say the in the eight years of Obama’s Presidency, there were two instances where a Federal judge stepped in to block an action.

In 2 1/2 years of the Trump Presidency, it has happened 37 times.

I suspect it is still Obama who believes he will always be President Emeritus, still active and influential but largely retired though still accepting $.

Did you even read my citation of 8 U.S.C. §1182(f) in Comment #15?

Congress created the Immigration and Nationality Act of 1952, which is still the basic and time tested foundation of our immigration laws.

The President is required by law to enforce that Act.

Congress waived the usual APA requirements for certain parts of that Act and delegated proclamation enforcement authority to the President.

If Trump could get the money and the regulatory approval for The Wall without committing a lot of his time and political capital to the project, he would build it.

The Wall would be helpful, but not decisive - for two reasons.

First, half the illegals in the USA arrive here legally and just stay after their visas expire.

Probably 90% of the women and children who get arrested at the border could come here legally on a visa and just overstay.

However, they are afraid to come here without their men, and most of their men have had previous arrests in the USA or their home country, so the men can't get visas.

The second issue is jobs.

A year ago, Trump had made fewer work place raids than Obama had made at the same point in their administrations.

Without Universal E-Verify, without vigorous prosecutions of employers, the USA job magnet will remain as powerful as ever, and illegal immigrants will continue to come here by the millions.

Regarding the administration, it seems the entrenched professional politicians and bureaucrats have not been properly dealt with. And, it appears that is Trump can’t do it, we may well be lost; living in the last days of a marvelous social experiment.

I don't think so. The statute says he can deny entry but asylum seekers are already being denied entry, that's why they're in detention.

Proclaiming that Central Americans are to be denied entry wouldn't affect their ability to apply for asylum but may make it less likely that it would be granted.

Apparently not because as far as I know the government didn't even bother to make that argument to SCOTUS.
