Taxing tampons isn’t just unfair, it’s unconstitutional
Los Angeles Times ^ | June 11, 2019 | Erwin Chemerinsky & Jennifer Weiss-Wolf

Posted on 07/11/2019 4:43:23 PM PDT by kaehurowing

If the government were to require that only men or only women had to pay a tax of several hundred dollars a year solely because of their sex, that would be an unconstitutional denial of equal protection under the 14th Amendment. Yet that is exactly the effect of the so-called tampon tax.

Yeah, but charging a wealth tax on people just because they have accumulated things that are worth money is totally constitutional. SMH.

Using that logic, taxing bras would be unconstitutional

Actually, here in the Republic of New Jersey, clothing is tax exempt.

Tampons are not necessarily gender specific. Their primary design is gender specific, but they can and are used as an absorbent for severe hemeroids. No they are not inserted but placed next to the affected area.

Never mind the leftist gender prejudice, there’s a leftist who hates a tax?

Everything including medicine is hit with a special tax in one of our new development districts in my neck of Florida. I was driving around a new retail development recently. Looking at the fancy new light poles and big palm trees every 5 feet and didn’t understand. It seemed way overboard compared to other neighborhoods here. Then I saw the new sales tax and understood. Ha ha.

Let’s see...

On the Bing search engine, one representative box of Tampax, super, 96 count, is $15.46.

At an average length of menstruation of 6 days, using 4 tampons a day, that box would last 4 months.

At 8% tax, the tax would be $1.24.

Three boxes per year would then bring the tax to $3.71.

This illustrates a few things.

First, that whoever wrote this article and those who believe it are mathematically illiterate.

Second, that the idea of exempting female hygiene items from sales tax is all about virtue signaling and not anything substantive. That $3.71 is not going to break anyone, nor is it enough to even cause one to have to make a decision between competing priorities. Or, to put it a way a leftist might understand, the yearly tax on that particular style of Tampax would not even cover the price of a single venti latte at Starbuck’s.
