If the government were to require that only men or only women had to pay a tax of several hundred dollars a year solely because of their sex, that would be an unconstitutional denial of equal protection under the 14th Amendment. Yet that is exactly the effect of the so-called tampon tax.

Not every woman uses tampons. Not all of us always need to use tampons. For some women a pad is just fine.

They must be organic designer tampons. The average sales tax is 5% so you would need to buy $2000 in tampons in a year to get to $100. If you use a dozen every period then you would need 144 per year. That is $14 per tampon.

In some places, food isn’t subject to the sales tax. Having worked in accounting for a fruit and nut company, you get all kinds of arguments for “we shouldn’t be taxed!” This creates insane complexity in the sales tax code.

Peanuts? Taxed. Salted peanuts? Often not taxed. Honey peanuts? Sometimes taxed. Chocolate dipped peanuts? Almost always taxed.

Their argument for “it’s essential” will lead to the same complexity of sales tax laws. If tampons are essential, someone will argue maxi pads and diapers are. You actually have greater need for diapers since you can use menstrual cups or get a Depo Provera shot that stops most periods. Or will those be listed essentials and tax-free, too? But the denim like diapers will be taxed as luxuries and generic brands will argue Tampax with pearls are a luxury so tax the competitor.

This leads to more complexity in the tax code as everyone argues are stuff shouldn’t be taxed.

Huh? Say what?!?! Won’t even get into the preposterous position being espoused...

That said: SEVERAL HUNDRED DOLLARS ANNUALLY?!?!

A box costs under $8.00 for a month...with a 10% tax, that is .80 x 12 = under $10 in tax annually.

SHEESH! This is what the Snowflakes are worried about?!?!

I've always wondered, do virgins use Tampons, wouldn't the hymen prevent their use?

BTW, I stopped watching the movie USS Indianapolis: Men of Courage, that happened in WW2, because some of the crew was making jokes about another crew member using Tampons. I don't tolerate such mistakes in movies, Tampons were not available or widely used until the 1970's.

I don’t know about consitutionality...but should there be a tax on tampons? That is a legitimate question. There are many items that escape sales tax. Certain food items for example. I think that if women believe that tampons should not be taxed, then they should lobby their state representatives to change the tax code. Hell, toilet paper shouldn’t be taxed either as far as I am concerned.

So, while many here look at it from a certain viewpoint...I look at it a bit differently. Lobby to change the tax law. Maybe all over the counter remedies should be tax free, like aspirin, for example. I am up for that discussion. In fact I am up for discussion on abolishing all sales and property as well as income tax...But that is me. Maybe others here like to pay all those taxes. (ducking as covefe mugs are thrown in my general direction)
