Huawei calls on Washington to 'halt illegal action' against the company

Shenzhen (CNN Business)Huawei is pressing on with its lawsuit against the United States, challenging the constitutionality of a US law banning federal agencies from buying its products.

The embattled Chinese tech firm said Wednesday that it wants Washington to "halt illegal action" against it, calling US restrictions on Huawei an attempt to put it out of business.

American politicians are "using the strength of an entire nation to come after a private company," Song Liuping, Huawei's chief legal officer, said in a press conference in Shenzhen.

Huawei has filed a motion for summary judgment, asking the court to overturn part of the National Defense Authorization Act. The tech company alleges that a portion of the law — which specifically forbids government agencies from using technology from Huawei and its smaller Chinese rival, ZTE (ZTCOF) — violates the US Constitution by singling out an individual or group for punishment without trial.

"The US government has provided no evidence to show that Huawei is a security threat. There is no gun, no smoke. Only speculation," Song said.

Huawei first filed the lawsuit challenging part of the National Defense Authorization Act back in March.

But that was before the United States slapped it with an export ban, effectively barring US companies from doing business with Huawei. The US Commerce Department placed Huawei on a list of foreign firms deemed to undermine American national security or foreign policy interests earlier this month. Listed companies are barred from receiving components and software unless the trade is licensed.

The Huawei lawsuit would be "a pyrrhic victory at best" in the face of the new US restrictions, said Paul Triolo, who specializes in global technology policy at Eurasia Group.

Interesting. Off hand, could be a “biil of attainder”. Though the Congress surely wasn’t so lazy and useless as to not consider something so obvious (cough).

Obviously doesn’t matter as there are other means, such as the recent EO, to do the same.

I think it was Thomas Jefferson that said something like, " America is (a) business " .... and with that in mind, China has been all out attacking us with their brand of boycot .... prices so low, human nature just had to buy them over American made goods of higher quality.

It took a successful businessman to put in place the braking mechanisn on that practice and first put on his directional to warn those following, and then applied the brake to make a sharp right hand turn.

President Trump knows the address where we want to live and is an experienced driver.

Since Huawei is, basically, a large criminal enterprise, I got no problem with that.

It is funny to see them appealing to the US rule of law, though. We should give them the same consideration an American corporation receives in China.

It’s not illegal.
And, the Constitution is about protecting the rights of Americans not Chinese.
When it was written, I’m fairly sure the Constitution was never intended to protect British citizens, just Americans.
