That may be true, but she was certainly engaged in treason and in the destruction of the evidence of treason.
OTOH, Avoiding FOIA archiving of HRC's evil doings (Clinton Foundation, etc...) was one of her prime motivations -- and a definite Federal crime, when she destroyed 30K of her e-mails. (Did you know that she absolutely refused to allow a government e-mail address be issued to her?)
I believe your understanding of the magnitude of HRC's crimes would benefit if you watched this video I created in advance of the 2016 election: "No Intent?!?" ...
Even today, the only detail of fact I would change is that some of that "stack of 'lost' Blackberries" were actually physically destroyed -- as in "smashed with a hammer".
