Don't blame it on the lawyers. He was convicted by a court martial. Evidently the members of the court became convinced that what he did was wrong. The fact that numerous experienced people supported him convinces me the court made the wrong decision.

I've been he senior officer on a court martial (drug case, not a killing). The JAG can argue his case, but it's the members of the court who have the final say.

I no nothing about his court martial except what I have read in the news including on whether he elected for a trial by judge only or by a general court martial board.

Since I do not know the specifics of his trial, my comments were focused on the general trend within the military that have turned the military justice system into the latest episode of NCIS or JAG. After I retired, I worked with deploying brigade combat team and special operations units preparing to deploy to assist with the Counter IED fight and Counterintelligence capabilities. I worked with both military JAG Officers and FBI Special Agents who deployed with these units. I also worked with the commanders and their general officer superiors, many of whom were personal friends of many years. I can just say that it was very different than my own combat experience when I was a very young infantry officer at the platoon, company, and battalion level.

I have also served as a President of General Courts Martial and of one Board of Officers who made a decision that was appealed all the way to the U.S. Supreme Court before they affirmed the Board’s decision without hearing the arguments. My own experience was like yours, accused soldiers generally received a fair shake from a Court Martial board. Once in was an exclusive JAG party, all bets were off. One of my War College classmate was a Marine who was commissioned after law school as a JAG officer. But, the Marine Corps required him to command a Marine Rifle Company before he was eligible to promotion to Field Grade. Good idea.

May God protect soldiers from anyone who wishes them ill.
