Deep state.
This is the part of the iceberg we can see. We at least know who and where they are. The part I worry about is the 90% of the iceberg we cant see.
A suit against the judge for every damned penny, and jail sentence the length of every damned criminal he abliged.
DACA has no basis in law.
It is blatantly illegal.
The Roberts Court ducked having to rule it illegal.
Trump Amnesty.
Why hasn’t the DOJ filed an appeal to stop this?
I am beginning to believe that POTUS wants this.
With catch and release, are these illegal aliens Given authority to work while they are waiting for their cases to be heard? Or are they knowingly and with the government awareness committing crimes by working?
My comment was specifically to DACA renewals, who have been living here already for many years at least (not that I approve of that). So its a different but related problem with current catch and release issues.
Blame the Alsup
STOP IT!
Trump is doing his best!
Force DACA to apply for resident alien or citizenship status! If you are going to be here, be here legally. Put a time frame on it. Citizen ship can be had after 5 years so I am of the opinion that 10 years to obtain citizenship should be plenty of time!
It was GWB and Obama.
Trump is trying to fix the problem and is being blocked by everyone including the courts.
Since then, four courts have stated that President Trump has the authority to end DACA as a policy decision ... the ball's in his court.
Regents of the University of California v. U.S. Department of Homeland Security : "To be clear: we do not hold that DACA could not be rescinded as an exercise of Executive Branch discretion. We hold only that here, where the Executive did not make a discretionary choice to end DACAbut rather acted based on an erroneous view of what the law requiredthe rescission was arbitrary and capricious under settled law. The government is, as always, free to reexamine its policy choices"
Napolitano v DHS: "All agree that a new administration is entitled to replace old policies with new policies [...] the new administration didnt terminate DACA on policy grounds. It terminated DACA over a point of law, a pithy conclusion that the agency had exceeded its statutory and constitutional authority."
Batalla Vidal v. Nielsen: "Defendants indisputably can end the DACA program. [...] The question before the court is thus not whether Defendants could end the DACA program, but whether they offered legally adequate reasons for doing so. Based on its review of the record before it, the court concludes that Defendants have not done so. First, the decision to end the DACA program appears to rest exclusively on a legal conclusion that the program was unconstitutional and violated the APA and INA."
NAACP v. Trump: "while immigration policies are generally so exclusively entrusted to the political branches of government as to be largely immune from judicial inquiry or interference, there are good reasons to scrutinize a policy more carefully when it is based solely on an agencys reading of domestic statutory law."
why not seal the border with troops? Close the border? Cut off Mexico, not just now after two years, several Central American countries? Where is work-place enforcement, enforcement of existing laws?
and why not more people in administration that reject amnesty, want a secure border, and will go the extra mile to deliver? Too many give lip service to immigration. Trump needs competent believers.
That statement is completely false.
I have been writing about this subject at Free Republic since 2017.
Trump's DACA Executive Order claims that Obama’s DACA Executive Order is unconstitutional.
Therefore, Trump says he should not have to enforce it.
Trump's own DACA Executive Order has been reviewed by about five judges.
Four of them have said exactly the same thing:
Trump has no power to declare that another president's E.O. is unconstitutional. However, Trump does have the power to write a new DACA policy - any time he wants to!
Writing a new DACA policy is exactly what Trump refuses to do!
Trump can “end” DACA tomorrow morning with this two sentence Executive Order:
“According to the exact language in the Immigration and Nationality Act, the DACA kids are unlawfully present in the USA. Therefore, I order the Secretary of Homeland Security to remove them.”
An Executive Order like that - based on the EXACT language of a statute - cannot even be reviewed by a federal judge.
Unfortunately, Trump does not want to deport the DACA kids, and he will never write an Executive Order that allows that.
Sorry, that is not correct.
Trump persuaded a group of Conservative state Attorneys General to withdraw their lawsuit BEFORE it went to the Supreme Court.
As to the legality....
The “D” in DACA stands for “Deferred Prosecution.”
As the chief law enforcement officer of the USA, Obama did have the authority to “defer” prosecution.
However, Trump is not helpless.
Trump can enforce the exact language in the Immigration and Nationality Act and deport the DACA kids, any time he wants to.
But, he is never going to do that.
You have no idea how the laws work.
