The Senate voted Tuesday to confirm Allison Jones Rushing, 37, to the U.S. Court of Appeals for the 4th Circuit, making her the youngest federal judge in the country.

The Senate voted 53-44 to put Rushing into the lifetime court seat. Every Republican present voted for her. Every Democrat present opposed her.

This is good news BUT....Before we get all excited about what a wonder job is being done filling Judicial vacancies, please consider the following OFFICIAL US GOVERNMENT information.

............................... JANUARY 2017: 115th Congress Begins — DONALD TRUMP BECOMES PRESIDENT

890 authorized judgeships with 112 ACTUAL VACANCIES (12.58%)

https://www.uscourts.gov/judges-judgeships/judicial-vacancies/archive-judicial-vacancies/2017/01/summary .....................................

JANUARY 2019: 115th Congress Ends — 116th Congress Begins (LINDSAY GRAHAM BECOMES CHAIR of Judiciary Committee)

890 authorized judgeships with 144 ACTUAL VACANCIES (16.17%)

https://www.uscourts.gov/judges-judgeships/judicial-vacancies/archive-judicial-vacancies/2019/01/summary

........................................... MARCH 5, 2019: TODAY

890 authorized judgeships with 153 ACTUAL VACANCIES (17.19%) See NOTE below.

https://www.uscourts.gov/judges-judgeships/judicial-vacancies/archive-judicial-vacancies/2019/03/summary

NOTE: Trump Nominees Alison Jones Rushing and Chad Readler who were voted on today (March 5th) were nominated NOT to replace incumbents who were on the list of 153 ACTUAL VACANCIES but to replace two incumbents on the list of 17 KNOWN FUTURE VACANCIES. Those two incumbent judges will move from ACTIVE status to SENIOR status once replacements are confirmed and ready to take office.

Here’s the KNOWN FUTURE VACANCIES list:

https://www.uscourts.gov/judges-judgeships/judicial-vacancies/future-judicial-vacancies

************************************************************************* For comparison purposes, the below shows the VACANCY Status at the end of GW Bush’s presidency.

JANUARY 2009: BUSH Presidency ends — Obama Presidency begins.

875 authorized judgeships with 53 ACTUAL VACANCIES (6.05%) with 26 Nominees Pending

Instead of today’s UNACCEPTABLE vacancy rate of 17.19% TRUMP and the SLOW-WALKING LINDSEY GRAHAM & US SENATE should strive to URGENTLY REDUCE THE VACANCY RATE to a more acceptable ONGOING rate of NO MORE THAN 5 or 6 percent. Republicans need to get serious and move faster, They also need to end the practice of allowing BLUE SLIPS TO BLOCK DISTRICT COURT NOMINEES.

“Every Republican present voted for her. Every Democrat present opposed her.”

This is all I know about Allison Jones Rushing. It’s really all I need to know.

I like her.

Democrats do not evaluate a candidate’s merit. They just vote as told. The US is hopelessly divided. It may never return to a unified country.

Women live longer than men. She could preside for most of this century. The Dems will have to learn to love her.

“Every Democrat present opposed her.”

It’s getting to be a very common scenario.

But, of course, should there ever be another Democrat president, The Stupid Party will get in line to approve his nominees because it’s the “bipartisan” thing to do, and “a president is entitled to appoint who he wants.”

If she works out well on the 4th Circuit, Trump should nominate her soon when the Notorious RBG assumes toom temperature.

Put her on the SCOTUS.

MAGA!

"Like most of President Donald Trump’s court picks, Rushing is also a member of the conservative Federalist Society, which has been driving Trump’s judicial selection process and funneling anti-abortion and anti-LGBTQ nominees to the White House. [...]

"The Senate is voting on two more circuit court nominees this week, both of whom, like Rushing, are young, ideological and Federalist Society members. [...]

"Trump is dramatically reshaping the nation’s federal courts. With Rushing’s confirmation, he has now gotten 32 circuit judges, 53 district judges and two Supreme Court justices confirmed. That’s so many circuit judges ― more than any other president confirmed by this point in his first term ― that 1 in 6 seats on U.S. circuit courts is now filled by a judge nominated by Trump."

FDR appointed William O Douglas to the Supreme Court when he (Douglas) was but 40. He went on to serve for 36 years, the longest tenure on the Court, and one of the most damaging.

And William O. Douglas was so senile by the time he quit, he forgot he quit and would show up in the building thinking he was still on the Court.

RBG could be following suit.
