I thought this had been decided already. It has been asked in the past on the census. It only makes sense to ask it.

Remember - judges aren’t political and for everything else Roberts has pushed thatbit goes through “the process” - now that the process was turning pro Trump Roberts deems it ok to get involved

This could, by some estimates, cost the Democratic Party anywhere from 10 to more than 40-45 House Seats.

Dems have a working plan:

Allow illegals to be counted in the Census same as citizens.

Offer Sanctuary and benefits to illegals.

Open the borders.

Increases Dems representation in Congress which also adds to their Electoral Votes.

What does John Roberts think? He’s evolved into the swing vote between the liberals and the more conservative justices.

I’m assuming that the four hard liberals will all vote that it is unconstitutional to ask about citizenship.

So John Roberts could well be the deciding vote.

Let me save Roberts the trouble...

The liberal justification will be this: asking this question forces people into self-incrimination, which is unconstitutional. Therefore, the question violates the Fifth Amendment protection and must be removed.

If the gov’t can send me a Census form pages long, well beyond a simple “how many live here”, and send a Census agent to my home to “remind” me there were more questions for me to answer beyond a simple “how many live here” (yes, literally happened, he was parked there waiting for me to come home, I told him “I answered what the Constitution requires” and he got the point from my tone that leaving was a good idea), and has enacted law fining people $100 for not answering all questions, then heck yeah they can ask “how many people living here are citizens?”

If SCOTUS rules that asking “how many living here are citizens?” is NOT allowed, then that will cause precedence for eliminating all other questions beyond “how many live here?”.

“The liberal justification will be this: asking this question forces people into self-incrimination, which is unconstitutional.”

Nope.

If I am asked, I will respond “4 people live here, 3 are citizens” which in no way is self-incrimination because the question does not address whether the non-citizen is a lawful resident alien.

It was asked on the extended forms that only went to select households. President Trump wanted it on all the forms.

“It was asked on the extended forms that only went to select households.”

I received one of them in 2010-——threw it in the trash.

Using that theory, if I was to be audited by the IRS, I could refuse on those grounds.
